Who is liable for the council tax?

If somebody has bought a property and on the mortgage claims to live in that property themselves, but instead rents it out to tenants whilst not declaring that on the mortgage, who is liable for the council tax?

The person "living" in the property is liable as they are the "resident", unless they're prepared to tell the truth about who is actually living there then they need to pay the council tax. Any enforcement action for non-payment will be in their name too.

Whoever lives in a property is the person who is liable for paying council tax.

(If no-one lives there then whoever is responsible for the property pays the council tax).

Whoever actually lives in the property is liable to pay council tax. (The council do not ask who owns the home, who the mortgagee is and whether they have sub-let with the mortgagor's knowledge or not).

If it's a single household, the occupier pays (except in a few specfic exceptions). The landlord lying to their mortgage lender is completely irrelevant to the tenant needing to pay their taxes!

If it's an HMO under a single joint tenancy, the occupiers pay.

If it's an HMO with multiple tenancies, the property owner pays. (The definition of "HMO" for council tax purposes is slightly different to that used for HMO licensing.)

The tenant is responsible for paying their council tax, the landlords mortgage is irrelevant.

Whomever physically lives there is responsible for the council tax.

Any lies the LL told their mortgage company has nothing whatsoever to do with council tax.

The resident is liable. It is the residents rubbish in the bins the council empty. It is the resident who is entitled to use the local libraries, parks and leisure centres. It is the resident who benefits from the protection afforded by the police and fire service.

The person actually living there but if I was them I would be looking for somewhere else to rent where things were above board
