To expect my full notice period to be paid?

I think i may soon be made redundant, we were given notice today that our roles were 'at risk' after being officially furloughed until 31st May.

Will I be paid my notice period (3 months)? Or is it just the one week per years of employment as the statutory minimum? I have been at the company for just over 2 years.

You should either be paid your notice period in lieu or work your notice period, plus redundancy pay. If you were under 22 you half a weeks pay now per year, over 41 and you get a week and a half per year.

As far as I'm aware they should pay your notice period unless the company goes bust / into liquidation.

I got made redundant a few years ago and even though they only gave us 3 weeks notice that they were closing the shop, they had to pay me my full notice period of 12 weeks on top of my redundancy pay.
I don’t know if the rules have changed since though.

If your contractual notice period is 3 months, then you either need to be paid that in lieu or physically work it.

However if that notice isn’t specifically
written into your contract then statutorily notice may well apply.

You will be entitled to payment for the notice period which is taxable, the redundancy payment which isnt taxable plus any holiday pay due up until the leave date which is taxable.

Okay that's good to hear, is there any chance they could use the furlough grant for my notice period (cap is approx 1/3 of my actual salary)

You should be paid for your notice period, regardless of whether you work it or not.

You should be entitled to redundancy pay on top of that.

You'll be paid for notice period, but the redundancy pay will be based on years of service, they're 2 separate things

DP (payroll manager) suspects that the "furlough rate" could be all you're entitled to be paid for any period where the furlough is in place during your notice period.

Your redundancy pay should be at your normal pay rate.

No I understand that, it's just there's a difference of £12k between what I'd receive if it was based on my salary or if it was under furlough pay. I'm beginning to fear it may be the latter :(

Well furlough pay is only meant to be paid to staff that the company intends to keep on. So if your company say to you in a week you've been made redundant, they can't actually claim furlough for you so doing your notice on furlough isn't really an option. They would have to either get you back in to work 3 months notice or pay you 3 months and you don't work it. 3 months of your full salary, paid by them which they can't then claim back

Furlough is being paid by the government to prevent employers making people redundant, they can't pay you furlough and make you redundant so you should receive full pay for the notice period.

You've misread that so no- furlough cap is 2500 whereas my monthly is closer to 7k. 3 months means 21k vs 7.5k
