To stop neighbours moving fence?

Please see the attached scrambled drawing.

Basically, are we in any position to stop the neighbours moving the fence that is also on our
land - possibly.

I'm not sure exactly who owns the fence, but at the end of the day it is what separates our drive from their land.

We've recently had our driveway repaved so there would also be an issue surrounding who should pay for the damage of removing the fence.

I'm more worried about losing the boundary when we do eventually come to sell up - they wouldn't be able to use the extra land for anything (unless they extended their drive which they said they don't want to pay for).

Their reasons for moving the fence would be to unblock their kitchen window, but all they'd see by doing this is our cars and the side of our house (no street or anything pretty)

If I say no would this stop them being able to do this? Or could they remove the fence without our input?

You shouldn't be letting then use any part of your land - you shouldn't be allowing them to open doors onto your drive, or use your property as a football pitch. They sound like piss takers and you need to nip it in the bud now. Check who owns the fence and if it's theirs, make it clear you will be replacing it if they move it.

It's the Transfer Document you need. There should be a plan attached with T marks. It will probably be a layout plan rather than as built

The red line on the HMLR title plan is indicative only as it follows the General Boundaries Rule. The Transfer document should help
You. However if the properties were conveyed on a layout plan then there is no guarantee the fences and indeed houses were built to the mm to the plans. However T marks will still show responsibility to maintain the feature. If there are no T marks don't assume anything. was just lazy conveyancing

The fencing 'convention' is nice side out (think opposite of Curtains) but these days with concrete posts and slide in panels it doesn't apply now. And some people don't follow the 'convention'.
