Not AIBU but need some advice

My partner is self employed but only started in August 2019. This means he is not entitled to the help the government are given to self employed people as he didn't submit a tax return 2018/2109. All his work has come via a recruitment agency and it is them that pay his wages. They also tax him the full 20% of his weekly way so he has not had his £12500 tax allowance, this is fine as it means he will get a nice tax rebate. They do not take national insurance.

My question is, as he has actually already paid tax that is due through the agency, would that mean he is classed as employed rather than self employed and as HMRC know exactly what he has earn't since last August would he get the help ?

If he's paying PAYE he's an employee, not self employed.

He has no contract with the agency, they just pass work into him if they have it. They basically source temporary workers for companies but they pay his wage and tax him

I think he might be classed as IR35. Have a look on the .gov website, it's very informative.

Thank you, I've had a look and it looks like that describes him but when I completed a questionnaire thing it still said self employed. I'll give HMRC a call on Monday - bet I will be in hold for ages though.
