National minimum wage workers and 80% pay

pawsies · 25/03/2020 09:01

Does anyone know much about this?

If nmw workers are expected to take home 80% pay then that would bring them under the nmw.

Is that legal? I appreciate having a job still, just trying to muddle through the logistics

OP posts:

If you qualify you won’t be doing any work, so I’d say it’s legal

barcodescanner · 25/03/2020 09:03

Hmm I hadn't thought about that. My employer just said she would follow government guidelines.

StatisticallyChallenged · 25/03/2020 09:04

Nobody knows yet as the full details haven't been released, but realistically they will have to make it legal or the redundancies will be enormous

Chasingsquirrels · 25/03/2020 09:05

Details of the scheme are very sparce atm, but my gut feel is thst NMW is hourly based - and if you are furlonged you aren't working any hours.

Northernsoullover · 25/03/2020 09:06

I'm in the same boat. Its my company so I don't even know if I'll get anything.
However I'm on my sofa doing nothing, I'm not spending money. In the scheme of things I don't think its right to get worked up about it.

zsazsajuju · 25/03/2020 09:06

No one is expected to take home 80% of their pay. The government will pay an employer 80% of an employees wage in some circumstances if the employee has been furloughed. The employer may pay them 100% or they may not

Nmagain · 25/03/2020 09:07

You aren’t working for that. I’m one of the few that needs to go in while most colleagues are getting the 80%. I’d much rather be getting that than go in bored out my mind for 100%. I’ll be on my phone all day basically doing nothing.

Tonyaster · 25/03/2020 09:08

Of course its legal! Companies are encouraged to make it up to 100 percent but they dont have to. You won't actually be working, it's a bloody generous offer.

Thehop · 25/03/2020 09:08

I’m a new worker and will be very grateful for (up to) 80%! Of course we won’t get min wage for being sat at home! We aren’t doing any work or spending anything going out!!

Thehop · 25/03/2020 09:08

nmw not new sorry

BodiesMakeForGoodFertiliser · 25/03/2020 09:09

You could say the same about SSP then.

Tonyaster · 25/03/2020 09:09

Nmagain employees cant just "get" the 80 percent. It's for businesses who literally don't have the money to pay full wages.

BigChocFrenzy · 25/03/2020 09:09

Some arsewipe employers with loads of cash reserves , e.g. Spoons,
are not even paying the 80% yet because they say the government will take weeks to refund them

Decent employers are paying 100% pay, making uo the 20% difference themselves

Tonyaster · 25/03/2020 09:11

You cant get the 80 percent if you have large cash reserves

MigginsMrs · 25/03/2020 09:11

Decent employers are paying 100% pay, making uo the 20% difference themselves

Not all decent employers can afford this.

OP of course it will be legal if the government pass a law saying it is.

FTMF30 · 25/03/2020 09:11

It's that or be made redundant. You'll be getting money for doing nothing. Don't be ridiculous.

pippong · 25/03/2020 09:12

What if you're employed but 0 hours?

Can you still claim?

Tonyaster · 25/03/2020 09:12

Decent employers are paying 100% pay, making uo the 20% difference themselves

Oh dfod

Some SMEs can't afford to do this as much as they would love to. Not all businesses are wetherspoons

Nmagain · 25/03/2020 09:13

tonyaster

Our business is huge. Three quarters have been sent home and are getting the 80% pay. That’s a fact.

Tonyaster · 25/03/2020 09:15

But the application process hasn't even opened yet!

Tonyaster · 25/03/2020 09:16

And if they are backdating they are taking the risk that they may not qualify

BodiesMakeForGoodFertiliser · 25/03/2020 09:16

@pippong find Martin Lewis on twitter. I think he talked about it or will be

nancy75 · 25/03/2020 09:17

The employer applies for it & the application page is not even live yet. Anyone paying it now is banking on getting the wages backdated by the govt, even though there are no real details about it yet.

LoudBatPerson · 25/03/2020 09:17

@pippong

You don't claim at all.

It is a grant for the employer to apply for if they want to. It is up to the company if they apply and if they choose to keep staff furloughed instead of laying them off totally.

Employees themselves don't make the choice or apply for anything.

Nmagain · 25/03/2020 09:20

All I’m saying is that I received an email explaining what was happening. I then received a phone call saying I had to come in. They must’ve had assurances that they’d qualify then.
