Best and final offer - can I do this?

Was told to give a best and final offer on a property within a day. Really liked the property - gave x amount, but the two other buyer both gave 10k more.

I am able to give more. The seller is currently deciding between these two and has rejected mine.

Would it be too late or too cheeky for me to counter these with another? If so, how do I play this? An offer hasn't been accepted yet as far as I am aware.

if you don't do anything, you won't get the house.

If you make your offer now, you might.

Why wouldn't you offer if you are serious and can follow through?

OP, you really should just trust your gut, not advice from MN. I got a very hard time on here a few months ago when I asked for advice on offers/
negotiations.

I stuck to my guns and trusted my instinct. We’ve got our dream home (after some renovations) for £40kish less than the asking price. Wouldn’t have happened if I’d followed advice here. Was told to offer the asking price as I could afford it!!

Of course you can!

'Best and final offer' is not legally binding, the vendor has no obligation to accept any of those offers, and there is no law stopping you making another higher offer.

You've nothing to lose by making another offer.

If I was the seller, I'd not entertain it. In simplest terms, you've tried to buy their property on the cheap, depriving them of 10k (as evidenced by the other offers) and now you've been rebuffed, you'd like another turn. Perhaps when thought of in those terms, you might reflect differently on the situation.

Yes, you absolutely can. "Best and final offer" is a stupid thing for an agent to ask, and isn't legally binding. Your best and final offer is going to be dependent and what offers there are against the property. You might be willing to go £20,000 over the asking price, but you would be mental to do that unless you knew someone else had already gone in at £15k over. Selling houses is a game of the seller wanting as much as they can get and the buyer wanting to pay as low as they can go, I wouldn't discount you as a buyer if you came I higher after a "best and final" offer.

I went back after losing a best and final ( which was asking price) and the vendor let us and the other buyer duke it out till the house finally 100k over the asking Shock
Sooo that vendor was happy
