To think I can't win against my architect?

I've almost completed my small build bungalow - one of the neighbours complained about an upstairs opaque window that wasn't on the original plan submitted to planning.

I had already mentioned this to the architect before the plans were finalised and was told - via email - it wasn't necessary to be that specific.

Next step now is to apply for a variation in order to get retrospective planning approved for the window at a cost of £235.

I asked if he will contribute towards the cost - as it was his inaccurate advice that caused the problem - and he's refused. I don't think there's any other option but to pay so that he can resubmit on my behalf. Angry

We have something similar, I was fuming but ended up paying, didn’t see another option. You could perhaps pay but say you’re doing it under protest, then put in a formal complaint via his complains procedure and then escalate to his regulatory body. I couldn’t do that sadly as mine is an ‘architectural designer’ ie not qualified and not regulated 😢 what a fool I was

@Skysblue I think that we must have had the same “Architectural Designer” he was an absolute tosser and we were left with an incomplete build because of him.

Mine has a habit of not responding at all - asking for him to contribute created the fastest reply ever!

Thank you for the idea of complaining afterwards though.

Check if he is registered with RIBA and if he is, tell him you will be logging the incident with them.

Can you submit as a Minor Amendment, would be cheaper?

He's not replied at all now to two emails - so I'm a bit stuck as I don't really want to involve anyone else.

He is RIBA registered though - so if I don't get any replies tomorrow I'll email to say I'll log the incident with them. Thanks summerwhisper.

I'm unable to find a minor amendment category on the local planning portal babymidget - I've been told by the planning officer that it needs to be put in under a variation of condition.
