Returning a car

Hi, sorry might not be the best place to post but couldn’t see anywhere else. Just wondered if anyone had any knowledge they could share around rights to return a car, if indeed there are any. Bought a second hand car which is around a year old from a well known car dealership two weeks ago. There is nothing wrong with the car but we just do not like it, it doesn’t have features that our old car did and we can’t take to it. We want to return the car or swap it with another car but the dealership will only take it as a part exchange and quoted us two grand less than we paid for it which seems ridiculous given we’ve only had it for two weeks. The car is on finance. Does anyone know if there is anything we can do? Thank you

Of course there’s nothing you can do other than sell it on privately or trade it in

It just strikes me as crazy that there is no cooling off period or money back period that you would have with most other purchases. Feel a bit daft tbh!

They may be a cooling off period with regards to the finance but I don’t know if that counts if you already have the car. You’ve probably exceeded the two weeks anyway.
Learn to love it ?

The finance seemed to think we had a 30 day window but the dealership aren’t supporting this. Finance company are closed today so will call them on Monday. Otherwise yeah it’ll be a private sale or learning to love it haha

Look at moneyexpert.com for rules about selling a car with outstanding finance. Some companies offer to pay the finance off.

You can’t return a CAR just because you don’t like it how bizarre! Fair enough if something was wrong with it but not because it’s not the same as your old car. That’s on you to research it and test drive it to find these things out.

It's like saying oh we've lived in our new house for a few weeks but don't like it as much as the old one can we get our money back? FFS. It's not a pair of jeans you bought online!

We bought an 18 month old VW recently and the dealership said we could swap it within 30 days if we decided it wasn't the car for us. I guess you have to be aware of the policies of who you buy from.

I hope you get used to your new car.

You have no rights, and I’d be careful about selling it privately-you will have to disclose the fact there is outstanding finance on it.

Did you not research?? It baffles me that you would finance yourself for potentially a few years on a car you didn’t research!

Yes I agree I have been daft which I said in my earlier message. I didn’t see the car before purchasing as it was in a dealership in the other end of the country and then delivered to one close to mine. It doesn’t come with things that I wrongly and stupidly thought would be standard in a car of this price and year.

Finance and car purchase are completely separate transactions. You have bought a car, a finance company has agreed to give you credit which you can use to buy said car, finance company may allow you to cancel contract with them - car company still need paid through another method. Just because you cancel one, it doesn't automatically cancel the other. Sorry OP, failing dealership goodwill it looks like your stuck with car unless you sell it privately.

Finance and car purchase are separate.

I bought a brand new car a few weeks ago, if I took finance out I could get a better deal and save around £1,200, I didn’t actually want finance but I wanted to save £1,200. So I took out finance, cancelled it within the 30 day cooling off period and paid the outstanding balance.

Being able to cancel finance has no bearing on being able to return to vehicle.

If you certain features were so important why would you buy a car that doesn’t have them?

If you didn't see it until after you bought it and can prove you asked to return it within 14 days it might be worth while researching distance selling regulations to see if your situation fits.

I’ll contact the finance company on Monday and will look into distance selling regs but I’m probably just going to have to accept I’ve been a dope. Thanks for your help

There's another thread going from someone who got scammed but a car remotely. They wound up losing the whole purchase price. I think some things are better done the old fashioned way.

Distance selling regulations haven’t been a thing since about 2014, even if they were it wouldn’t apply as OP purchased from a dealer, not via an online transaction. OP also isn’t covered under the consumer contracts regulations due to not being a distance buyer.

My dh did a similar thing. Had his old car from new for seven years. Traded it in for the exact same car again. Obviously in seven years there have been slight changes. The salesman didn’t have the exact model in the showroom and my dh assumed it would be the same. It is mostly but there are a few niggly little things that he doesn’t like about it. It’s got a massive touchscreen that controls nearly everything and he doesn’t like it. It doesn’t have a CD player, just Bluetooth but dh doesn’t download music. Fewer storage bins. Just small things but they annoy him. He should have held out for one to come in to look at. No point trying to trade it back in, it would now have one more owner on the logbook and a few miles on the clock and have depreciated massively.
