Should I claim compensation or should the sender?

So I ordered an item from eBay in December which never came. The tracking shows as never even being out for delivery. I have contacted the seller who has told me I have to claim compensation for the parcel and there's nothing they can do. Royal Mail website says that either party can claim. I obviously don't have proof of postage though I do have the tracking number.

Whenever I have reported to a company/business that I didn't receive the item then they have refunded without quibble so I wasn't really expecting anything different (naive of me no doubt but I've never had an issue with private sellers/parcels on eBay).

So, should I do the running round for compensation or should the seller?

complain to ebay and paypal and they will refund you

It's the seller that needs to do it. can you not claim through Ebay itself?

I've lodged a complaint or whatever with eBay and been liaising with the sender but the sender has told me it's up to me to claim from Royal Mail. Having looked at their website I don't see how I can as I don't have all the details. For instance, where and when it was posted, where the seller lives, how much they actually paid for postage and what method they used. It's frustrating because she's indicated she thinks I'm lying. It was a piece of clothing that I paid less than £8 for. Why would I bother?

I expect eBay will likely refund me automatically but I don't know if that means I will end up with negative feedback? It's barely worth the hassle for such low value.

She can't give bad feedback anyway can she? You can give her bad feedback but not vice versa.

The sender is lying. Open up an “item not received” case with eBay.

Yes open a case with ebay as 'not received ' and ebay will.refund you. The person who sent it has the proof of postage so they claim it back from royal mail themselves after you have been refunded. She's trying it on. Ignore the seller and only deal with ebay.

Unless its changed, you can't leave buyers negative feedback on Ebay. (Though you can leave positive feedback and a comment).
I would definitely claim via Ebay.

You only get 30 days after purchasing to open a case with eBay. Beyond this they won't force a refund so you need a PayPal claim not eBay. The seller does have to make the claim themselves, not you. They have the contract with Royal Mail and the proof of postage. Don't know why they are being so silly about it as it's really easy to claim. Unless of course they didn't send anything in the first place.

@delilah that's what I thought. She keeps saying she can't file the compensation claim because there's a declaration saying 'parcel not received' and she can't know that. I said of course you can sign that because I'm telling you I haven't received it. If Royal Nail want to dispute that with proof of delivery then she can show she filed in good faith as I've claimed that in messages. You're all right, she is trying it in but she made me feel like I was taking the piss and I need to take it up with Royal Mail. Thanks for comments and making me feel like I've done the right thing

Open a not received on eBay. You'll get your money back.

It's up to the sender to sort out the claim with royal mail - not you.
They can't leave bad feedback, but you can for them.

As every other poster has said, file a "not received" case on ebay and job done.

Hope you've opened that not received item case with eBay. Just update them that seller hasn't refunded. Then it's up to seller to claim from PO. It doesn't matter what she says to you (unless she has proof you received item on tracked parcel service which she would submit to eBay ) as eBay favours buyers. You'll get a refund sharpish and no she can't leave negative feedback.

Seller needs to claim, not buyer. The ‘contract’, so to speak, is between her and Royal Mail, not you and RM. she paid them to deliver it, they haven’t. I sell quite a lot on eBay and I would never expect the buyer to sort out a claim - I’m the one with the proof of postage receipt!

Refund was issued today so I think she was trying it on yesterday in the hope I would do the compensation claim myself and cancel the refund request.

It was an eye opener though as she nearly had me doing all sorts. When I first contacted her she basically said 'oh that's too bad. Sorry you didn't get your parcel. I sent it so not much else I can do '

Anyway thanks for letting me know I'm not crazy!

They claim - thier contract with PO - your contract is with them - escalate the claim with eBay and PayPal
