Can anyone help me with some advice so I don't get sacked? Pregnancy sick leave!

Hi all,

I've written here a few times about work related things and it's been really helpful. My work are quite uptight and I just wanted to know if anyone can offer any advice before I email them.

I have two jobs as a freelance writer - one with full time hours, 9 hours a day five days a week and the other takes me around an hour and a half a week and actually provides more income than the full time hours.

I have been on sick leave from my full time job for the past four weeks and so have not been working the extra hours for my second job in this time. However my sick leave now ends and I am only entitled to £92 a week from now on.

I have extremely low iron which is the reason I have been off, because I am exhausted all of the time, and today I was diagnosed again with low iron despite being given more tablets, and also gestational diabetes.

I spoke about sick leave with my doctor and she agreed that it would probably be best to take off from my full time job until maternity because I'm not coping with it - no concentration, motivation and sleeping all the time!

She suggested I take sick leave from my full-time, don't accept sick pay and instead do my hour and a half of side work so that I still have an income until I go on maternity.

Do I have a right to do this? I also have so many appointments with my pregnancy as I am high risk, have bipolar disorder and also have inflammatory bowel disease so it's making it difficult having to take time off all the time anyway.

As far as i am aware, you cannot claim SSP (Statutory Sick Pay) when still working a second job. If you didn't want to let the full time employer know you'd still be doing the 1.5 hours per week then just tell them that you will be claiming the sick pay from your other employer. Just to make you aware, that if you are going to claim maternity pay from your full time employer, then they can start your maternity leave early if your are off sick long term. Not sure of the rules but may be worth looking into.

You can be off sick from one job while working another as it's possible to be fit for job 2 and not job 1 at the same time. However you are likely to lose 4 weeks of maternity leave from job 1 as they can trigger it early.

You could ask for a fit note stating you can work 1.5 hours a week.
