Who was in the wrong? (car accident related)

Out with my friend in her car today. She's a fairly new driver and has black box insurance.

We came to a blind bend with a car parked in our lane on double yellow lines. Friend moved over and drove around the car at probably 10 mph.

A car coming the other way clipped her car and has done quite a bit of damage to the front end. The car was doing 20mph roughly which is the speed limit.

My friend clipped the parked car and took the wing mirror off, doing some damage to the bumper too.

Both drivers are blaming my friend (she's the youngest/least experienced driver.)

I say the parked car driver is at fault because they were parked on double yellow lines and if they hadn't been there the accident would never have happened.

All been referred to the insurances of course, including pics of the parked car.

I'm feeling very stiff and achy and will probably miss work tomorrow (it's aggravated my already bad back) and poor friend is really upset and shaken.

Your friend is NOT at fault, the highway code states that a driver MUST give way to an oncoming car if it has started to move past an obstacle even if it is on thee oncoming car''s side. People never seem to know this rule!

@Mermaid67 not if they can't see the oncoming vehicle. The OP has even said that she believes that the oncoming vehicle would had stopped, had it been a straight road.

suppose technically she was in the wrong, but I totally sympathise. 2 weeks ago I was coming out of a road to turn right. Guy on my left stopped, I looked right, nothing there, looked left to make sure guy there had definitely stopped, looked right again,nothing there , pulled out slowly, boom! Sat there in shock for a couple of minutes then managed to get out of car on passenger side, as driver side was damaged. Woman got out of her car "I hope you've got insurance" she said, followed by "you wasn't looking" to which I replied "I was looking, you must have been going really fast." She said " I wasn't going much more than 40" That was a 30 mile per hour zone. But apparently she could have been going 90 and it would still have been my fault. My poor car was a write off. Not much wrong with hers.

@dimdarkashian do you know what a blind bend is? Have you ever seen one? Have you ever been on narrow country roads? Have you ever been to Yorkshire Grin I suggest you do so and then come back and say the car had enough time to stop. Impossible to say without witnessing the situation

Your friend should have stopped and waited for the oncoming traffic to clear before she moved around the illegally parked car.

I think the driver who parked in such a stupid place is at fault as its not possible to see if its clear before pulling out on a blind bend but the insurance are going to say it was your friends fault unfortunately
