Ticketed for stopping - I was not driving - AIBU to think I shouldn't be paying?!

Please help me, I am desperate for some honest advice.

In August I received a ticket for stopping for 4 minutes in a no stopping zone on a Sunday. I was in hospital when the ticket was issued and 4 people were insured on my car to help with DC and logistics.

I wrote to the parking company and said I was not the driver and I would write asap when I knew who was. I wrote back a week later identifying DH as the driver and giving them his details. They contacted me again demanding an increased payment. DH wrote and said he was the driver and offered to settle, he also told them I was back in hosp and repeated that I not the driver.

They wrote again demanding another increase, I wrote again asking for the original fine to be issue to DH (and obviously wishing I'd just paid the first one).

I have now received a letter saying it has gone to court - I had no idea - and it is a huge £270 bill. If I don't pay there will be bailiffs coming to my home.

I don't understand why I am responsible for the charge when we have sent 4 recorded delivery letters. I thought it was very important to be honest about who was driving as you must be on speeding tickets etc but this seems to have been a mistake. If I'd paid the original £120 I wouldn't be threatened with baliffs now.

I am utterly confused what to do. I think I will be diagnosed with MS next week, all investigations are pointing to it. I am depressed, utterly penniless after so much time off work and now can't stop shaking and worrying about baliffs.

I rung the number on the letter 3 times but it took over 20 mins to get thru each time and then someone just shouted 'hello, hello' then hung up.

WIBU not to pay the first fine when I was not the driver?
AIBU to expect them to issue the original fine when they know the driver?

I feel like I am being extorted and cannot understand how this is legal. Please advise on what I should do if you have any ideas. And if I have been an idiot and caused all this problem myself please go easy on me. Thank you.

A fine (sorry parking charge) for 4 mins does not sound remotely proportionate. I am surprised a court has allowed it in your absence - surely they have to show that they've taken reasonable steps to contact you. I am not sure what the appeal process is once something has gone to court, but there is one. Maybe go to citizens advice.

By the way are you sure it has gone to court or have they just said so? Have they included a copy of the court''s judgement? It wouldn't surprise me if they lied just to extort more money.

I am back in hospital for 4 days from Monday, which is why I am freaking out. It is an absurd charge. It was 4pm on a Sunday and DH stopped in the Spinningfields area of manchester to pick up my Grandma who was a bit tipsy in Albert Schloss and couldn't manage the car park stairs - she is 95!
It seems unbelievable I know, but I have the fine here in front of me.
EOS Parking are the claimant, Gladstones solicitors prosecuted.

me or DH replied to every letter recorded delivery.

I’m sure they would need to have a court hearing before they send it bailiffs. They’re trying to scare you.

I can't understand how it could have gone to court without you being notified so that you could give your side of the story. Doesn't sound right to me.

Were you going to get points on your license or something? I don’t really understand why your husband didn’t just pay the original fine if he was the driver. Would have saved all of this hassle.

Have you tried contacting the court? I'd want to let them know that you weren't informed in advance of the court date and that you want to dispute the case.

If you read the letters carefully they are usually worded like it's going to happen but they deliberately use language that suggests it but doesn't actually mean it. What does the letter actually say?

Who actually issued the ticket? Did they actually give you the option to say it wasn't you and to identify the driver or was it just an invoice?

Parking companies don't care who the driver was. All they'll go by is who owns the car.

A parking fine isn't the same as a points for a driving offence. I don't think it really matters what name the fine is in does it? I would have just paid it.

If you get a letter saying you've been caught speeding for example there is a section on it to complete to say it wasn't you as it's an offence not to inform the police who the driver was. A civil parking fine has no such implications. I'd be surprised if the parking company have a process for assigning it to somebody else's name at all.

Join Facebook page Private Parking tickets - Help and Advice. Post the PCN with your details and number redacted and ask for help. Their admins will give excellent advice although shame you named the driver...they will explain why

Gladstones solicitors are notorious for sending out letters that look like potential court action and are infact just threats. Try a site called pepipoo. Theres lots of really helpful people there who can look at the letters and tell you your best course of action. A lot of these so called fines are not infact a council or police fine but just an invoice from a private parking company. They have continued to harass you because they dont care who was driving they often just want to scare you into paying and by responding to them they know they have a fish on the hook and will continue. Appeals are useless. they all fail,

If it is an actual judgement, which I doubt, I would write to the court and inform that you have a County Court judgement but that you were not notified of the hearing. In fact, do it anyway - they will soon tell you if there has been an actual judgement or not.

When I have called the court I am on hold for 20-30 mins then then the call hangs up, or on one occasion someone shouted "hello hello" then hung up.

@PinkiOcelot I agree I should have done that. I have never had a parking fine before and have been in a confused state for a while thb. I was in hospital and thought, for some reason, it was fraud to not disclose the driver. I know I haven't handled it well but this is really disproportionate.

Sounds dodgy. Don't pay it. Are you phoning a number they have given you for the courts or one you've found?

Is that the number they gave you for the court? You shouldn't believe a word they say.

If it went to court you would have the right to have your say. You haven't had that right so it hasn't gone to court.
