Parking ticket...

Ok, not really an AIBU but I have no idea where to post this...

I was 3mins over my parking ticket, the warden has handed me the fine. Do they not have to have a photo of the fine on your windscreen ? It’s a private car park if that makes any difference.

Why would they need to do that? They issued the fine directly to you in person, and therefore they don't need to evidence that it has been issued in your absence by taking a picture of it..

I guess you're going for some sort of appeal angle to say the ticket is invalid as it wasn't issued correctly?

Private car parks pretty much make up their own rules. If you were in a council car park they give you 5 or 10 minutes grace after your time runs out. I know this isn’t helpful, but just saying you would probably have to read the car park’s T&Cs usually located on a tiny board behind a bush somewhere.

they will have already taken the photo of the car still in the parking bay beyond the paid for time so they have the proof they need that you broke the Ts&Cs.

the photo of the ticket on the windscreen is often taken as additional proof in case you decide to ignore the fine and then claim to have never received the paperwork when they start taking legal action. (a) that would be fraud and could end up with you in a heap of trouble and (b) they probably have cctv footage of you being handed the paperwork.

pay the fine and park according to regulations in future. no one is so special that the normal rules shouldn't apply to them

No they dont have to take a picture of it in your window. Some places choose to so that unscrupulous people can't claim that it fell off or something and try to dodge the fine.

You were over time. Pay the fine.

Hi OP

I work in the Private Charge sector, on the legal side.

All you can do now is appeal it within 28 days of the date of the notice, they will then either reject or accept. If they reject, you will have the opportunity to appeal further but will lose your right to pay the reduced amount if you lose your appeal to the independent association.

The only photos they need is of your vehicle, number plate and any evidence that you were overtime I.E the P&D ticket in your window as the photos are time stamped they will show that you had overstayed.

Also please don't listen to anyone that tells you to "ignore" parking charges issued on private land, they are becoming more and more strict and I deal with people who are or have been issued a CCJ after not paying and it progressing to the car park company's solicitors.

Either appeal or get it paid at the reduced amount whilst you still have time x

If you're 100% sure it was only 3 mins and can prove it (e.g. time on your p&d ticket v ticket you were given) then you may actually be ok. There are two main private parking codes of conduct and i think both allow 10 mins grace to leave the car park. It should say which the private car park is a member of on tje ticket.

The MSE website has very good advice on this.

You have 14 minutes leeway on a ticket by a private company in a carpark.

Was the ticket left on your windscreen or sent in the post?
If sent in the post how many days between the parking and the fine/invoice sent?

Really @ivykaty44? I thought the government were proposing 10 mins in private as is for council car parks but that code of conduct hasn't been adopted yet?

Having been done in a council car park for two minutes passed he literally was rushing the ticket as we ran back to the car. Not all councils give you a grace period.

It was about 5 years ago so maybe the rules have changed as did ask about grace periods and did appeal but told didn’t have to give a grace period.

That's so fascinating! Am I reading it right though - a minimum of 10 mins grace period but this is only if the private parking owner is a member of the BPA? I.e it's their core of conduct.

So it's not unilateral law yet?

Doubt it would ever be passed through Parliament to be made law, many codes of conduct are jyst that. If you appeal and lose you can take though courts and try again. Very rare that someone will take to court to make “a test case” therefore these companies continue to do what they do on private land to store your car

It’s cool I’ve paid it! I can’t be bothered with the Agro of it. I was probably more annoyed because the warden was ridiculously rude and I just think 3 mins over...come on, it’s not like I didn’t pay for a ticket.
