Hello all
I need some urgent advice.
Me and dp have split up. He moved out the other day. I have contacted the the council to say he is no longer living here and to take him off the council tax. I have updated my universal credit to say we are no longer living together on my online account. Will I need to show them my new council tax bill when I get one?

I have managed to find a job thank goodness as I was a sahp. So I will update them on that once my job starts. I will lose out on money but hey ho.

The split was fine and we are getting along fine but won't be loving back in together.

The problem is he has moved out but the landlord won't let me stay on the tenancy alone and ex do is happy to stay on it even though he won't be paying. Will this be an issue for my universal credit? Will I need him off The tenancy agreement or need to prove he's moved out some how?

Yes you will need him off the tenancy, would the landlord allow him to be a guarantor instead? Or would your parents or someone else go guarantor? That would be even better.

Yes it might cause you problems. I've known cases where it has caused problems and a few cases where it hasn't. Its likely that UC will only cover your half of the rent until you get him off the tenancy agreement.

Yes he needs to come off the tenancy. UC very strict about this when applying for housing element of UC

You can ask landlord to confirm he is aware you are 100% liable for costs now be has left but won't be reissuing a tenancy. DWP can then refer to decision maker to consider 100% costs

Will they ask for a new appointment. We had a joint claim. He is no longer on it. So in guessing they will ask for a new appointment

It will cause problems as the default is to split 50 50 between tenants. However they have the discretion to change this, and you will be likely to succeed if you can show he is not living there. Relevant legislation is UC regs schedule 2: www.legislation.gov.uk/ukdsi/2013/9780111531938/schedule/2/paragraph/2

Essentially UC need to recognise they cannot force you to change a tenancy and if you are in practice jointly liable for the rent but one is not living there and not paying, they can cover it.

I got around this by supplying a statement from my ex confirming he has left the property and if you can supply evidence from your landlord stating he is unwilling to change it to single. I still managed to get my full housing element
