To think my landlord/estate agents should give me a set date and stick to it?

I moved into a new home last week as I am 19 weeks pregnant and wanted to move closer to my family. I gave my notice in on 20 October and so my tenancy ends on 20 December, which is fine. I have paid rent up until 10 December (as that was my monthly arrangement, the 10th).

Anyhow, I had originally asked if there was any chance the landlord would allow an early release and she said no, which I said was fine, I'll keep paying rent and bills until the end of the tenancy.

Anyway, my landlord found a new tenant and the estate agents have told me they want to move in on 7th December, and so now all of my stuff needs to be out on the 4th December (I have an end of tenancy clean planned and rubbish removal from the front of the property).

They have told me I will get two days of rent back because I paid until the 10th.

However when I followed up with them about the rent, as I assumed I would get it within 3-5 days and didn't, they told me that they will only refund me if the new tenant moves in, and if they decide not to move in in the end, that I will be liable for everything until 20 December as planned.

AIBU to think they should give me one date and stick to it? I would have rather they said the 20th or the 7th, but now they're telling me that it's dependent on whether the tenants even want to end up moving in. I feel like I'm being rushed to get all of my things out/clean done/bills closed when I could be taking it at my own pace had I had until the 20th? Is there anything I can do?

Must add I work full-time and so I didn't want to be really rushed to do everything as I am 19 weeks pregnant & living alone, so it is going to be really stressful!

You don’t need to be messed around like this. I would tell them that you are paying rent until the 20th so they can’t do anything until then.

I'd tell them it's the 20th unless they legally agree to move it or tell them stuff it. They are trying to have it their way every which way.

And I say this as someone who had to rent properties due to them not selling and they are truly taking the piss.

I would say as you have paid up to 10th you are not going to give back the keys til 11th and new tenants can be in then.

So confused why you only get 2 days back if they want to be in on 7th. That is 4 days surely? 7h 8th 9th and 10th.

If the terms of your contract state that you and the landlord both have to give one months notice to terminate the tenancy:

  1. They can ask you if you are willing to leave before 20 December but you don't have to.
  1. If you do agree to leave by 7 December, that agreement needs to be put in writing and the mutual agreement to end the tenancy on that date then supersedes the contract. They can't have it both ways. If you agree to leave early, they can't then hold you to the contract.
  1. Why are you only getting 2 days rent back if you have to leave by the 4th? I would also ask for the money to be refunded as soon as you make the agreement.

I read it as out by the 4th so she can fulfil her end of tenancy obligation for the 7th (as in her own choice to leave a few days earlier so the company she has hired can clean)

It should still be 3 days, in that case, TrollFairy, as if the new tenant moves in and starts paying rent on the 7th, the OP should be leaving on the 6th so there is time to do the inventory etc and there aren't 2 tenants paying rent for 7th December. Otherwise OP could refuse to leave until midnight...
