Our house (we are selling) has been sale agreed since June. The sale has been held up multiple times by the vendor’s solicitor.

We agreed a closing date and the buyer put a lot of pressure us via estate agent and solicitor to close early. So we moved out a week early to a rental. The closing date came and went a fortnight ago and still no funds. Now we are paying both mortgage and rent. Buyer’s solicitor keeps sending empty promises. I popped into the house to check for mail and three parcels are sitting inside for the buyer.

AIBU to think pay for your bloody house before getting your Christmas presents sent here? Feel like returning them with “not at this address” but not that petty. (Only just though).

Very cheeky having parcels delivered to a address that they haven't moved into yet isn't it? Send them back to p office and send some ultimatums to them ie deadline and get a lot harder. Don't let any deadline be broken again as they're going to see you as soft and mess you about .

Surely the whole thing hangs on whether contracts have been exchanged? I took "closing" to mean completion, but then OP also seems to have confused vendor with purchaser, so ...

We were late completing on our last purchase due to funding (v complcated, following business sale so not likely to be something frequently occurring) and got fined something like £300 per day we were late. That was fun. Hmm You may get some extra funds through? I don't actually know where our fine went....

You use some terms that don't sound as though this is the UK. Is that right?

The contracts have been exchanged. The parcels fit through the letterbox. The fund were not released by the date on the contracts. They can not withdraw from the sale now and I don’t want to - I just want our money! They don’t have keys.

They now owe interest because of late payment and have sent a message via solicitor asking us to waive the interest. I told my solicitor to use polite legal language to tell them to fuck the fuck off.

I won’t return the parcels but I am gobsmacked at the cheek. The person who said take it as a good sign is quite right. Thanks for showing me the bright side :)

Yes I did make a mistake in the OP - the sale has been held up by the buyer’s solicitor, not the vendor’s!

I don't know the system in Ireland.

In England, that would be fine, it's legally binding (the only thing that is binding!), and you could claim any expenses you get for a delay in completion. Your solicitor would advise you to and you would be crazy not to. So any hotel, any storage fee, any rental, utilities for the house you are selling, insurance and so on.

I hope its the same in Ireland, so you won't be out of pocket at all.

I think the Irish system is pretty close to the English/Welsh system so, if contracts have been exchanged, the vendors are liable for any costs arising from the delay. Your solicitor should be advising you on this - you shouldn't be out of pocket.
