Sportswomen parking WIBU?

Spotted this parking war in the papers today. Who do you think is being unreasonable? Obviously the courts will ultimately decide but just goes to show title deeds are never 100% on what they mean vs how they are interpreted.

To be fair, we don't know what the deeds say. There may not be a right of way. The newspaper story doesn't give enough detail.

I originally read the article in the Times but because it's behind a paywall I found an open link to it. The Times story said

'Mr Gaunt said that a deed granted right of way “for all purposes” and requested an injunction that would prevent the Collertons from parking in the entrance to the driveway.

The Collertons, who live next door in £1.5 million Queen Anne’s House, run a sports website. Collerton competed in sculling at four world championships and in 1986 she and her rowing partner won the silver medal in the lightweight double sculls. They claim that the right of way allowing the Vances to use their drive only extended to cars dropping off or picking up.

Kerry Bretherton, QC, for the Collertons, defended their positioning of their car, saying the entrance to the drive was the only part wide enough to allow two vehicles to pass.'

Looking at the photo I can't see how the C's can park on their own drive if the V's have right of way to drive a car up it and park on their new parking space

Where were the Vances parking before they installed the space? Why do the Collerton's think the right of way means only picking up and dropping off. Not enough detail here for enquiring minds Angry Grin

It looks like there is a garage at the top of the drive. Wonder who that belongs to?

@Nicketynac The article I read said the C's used to park their car in front of the garage until the V's created their parking space and now have to park it in the entrance as it's the only bit wide enough for 2 to pass.

@CathyorClaire so I'm presuming not on the C's driveway! Right of way when there's no where on their land to stop & leave it is probably a reasonable assumption. Creating somewhere to stop and leave it creates a new need to a new interpretation.

I just can't believe a right of way for the far house (V's) which prevents the owners of the drive (the C's) from actually parking on their driveway would ever be granted.

Found it on Google Earth. It genuinely doesn't look possible to park anywhere on the driveway except the entrance and allow the V's access to their parking space. Looking at the tyre marks the C's can't park in front of their garage anymore or it blocks the V's.

You'd think the Vances would have anticipated such an issue and had civil talks and perhaps a contract for access drawn up with their neighbours before creating said parking space.

Will be watching this closely as my husband and I are in a similar situation. Our neighbour can't get a car to her house but she can load/unload on our drive (the drive leads to pedestrian access to her house). She 'unloads' for long periods most days and prevents us getting to our parking space as drive is only wide enough for one car. Its so stressful and relations are at an all time low. Interesting to see a similar case making headlines as we are considering legal action against her for blocking us out of our own drive for unreasonable amounts of time.
