Can they charge me for this?

Booked a week in this country (England) in January in a holiday barn. Wasn’t clear at time of booking that a larger deposit was going to be requested at the end of this month, which is not refundable even in case of cancellation.

I need to cancel for a few reasons.

Thinking of cancelling the card they have on file and ignoring the letters I know they’ll send to my home address Blush

They’ll want around £250. Is this something they’d pursue vigorously do you think? Anyone any experience of these kinds of things?

Aridane

Thank you, I am well aware of that. Grin

You forgot the NBP.

What I was trying to illustrate to the OP that it is not going to go away, hence why I said if she called me I would discuss instalments.

TatianaLarina · 12/10/2019 15:02

Why not consider the actual owner of the property, not just the company.

I can’t imagine why you booked the holiday without reading the booking conditions.

Passthecherrycoke · 12/10/2019 15:03

I’m really confused by this. As others have said if you cancel now you owe nothing do you?

The barn could be owned by anyone. It could just be a family barn, most the ones we’ve rented are. Mr and Mrs farmer aren’t going to sell your debt (which doesn’t yet exist?) on to a debt collector. This thread is so odd

BritInUS1 · 12/10/2019 15:10

Speak to your insurance company, they should cover this if you have a good reason to cancel

Saucery · 12/10/2019 15:15

Talk to the company/owner. They may waive it, if they can fill that week. Or they may not, but trying to avoid them by changing your bank card is a stupid thing to do.
Even the larger companies don’t deserve to be out of pocket because you can’t fulfill the booking. Smaller ones definitely can’t so don’t be the dick that tries to scam them.

TatianaLarina · 12/10/2019 15:24

Completely missed the point. The owners stand to lose out financially.

TatianaLarina · 12/10/2019 15:25

By the sounds of it OP has already paid a deposit and thus is committed to the next one. Sometimes companies take an immediate 10% deposit and then 40% and then 50%.

wowfudge · 12/10/2019 15:49

No - it sounds as though she's paid a low deposit with the rest due by the end of the month. She specifically called it a deposit. What you've described Tatiana is a staged payment.

Passthecherrycoke · 12/10/2019 15:52

That’s how I read it wow fudge. Don’t understand why op doesn’t just cancel now

MrsMaiselsMuff · 12/10/2019 16:45

They should cancel now. However they will still be liable for the remainder of the deposit.

Inliverpool1 · 12/10/2019 16:47

If you just cancel the card sometimes the transaction goes through on the new one if it was authorised on the first one, that definitely happens with subscriptions

Aridane · 12/10/2019 16:50

Liverpool is right - if you want further payments not to go through on the card, you need to tell the bank who are the. Obliged to honour that instruction -

www.citizensadvice.org.uk/debt-and-money/banking/stopping-a-future-payment-on-your-debit-or-credit-card/

It obviously doesn't cancel your debt but does mean you aren't cutting up for your card which is an ineffective way largely for preventing payment being taken

bobstersmum · 12/10/2019 16:56

Definitely ring them and if you can't cancel then rearrange for later in the year!

TatianaLarina · 12/10/2019 17:04

Which is what I said. Splitting the deposit is a staged payment.

She’s paid a deposit of 10% so she’s committed to the next part of the deposit as she describes, and the balance of 50% will be due later.

Passthecherrycoke · 12/10/2019 17:31

No wow fudge is saying the 2nd part of the deposit wont be due if she cancels now

MrsMaiselsMuff · 12/10/2019 17:50

The second part of the deposit is still due irrespective, that's how low deposit offers work.

TatianaLarina · 12/10/2019 17:50

Why would OP start the thread if she could cancel now or consider cancelling her card? Whatever is paid is paid, it’s the next part she wants to get out of.

TatianaLarina · 12/10/2019 17:52

The second part of the deposit is still due irrespective, that's how low deposit offers work.

Yup.

wowfudge · 13/10/2019 08:38

Passthecherrycoke - no I'm not. At the start of the thread when I first posted I thought the OP was dithering about when to cancel, then she clarified that it was part of the deposit she was on the hook for.

Tatiana it's not clear whether you mean the deposit was paid in three tranches or 10% [of the overall cost] was the total deposit.

TatianaLarina · 13/10/2019 08:47

I’d say that’s clear enough:

She’s paid a deposit of 10% so she’s committed to the next part of the deposit as she describes, and the balance of 50% will be due later.

That’s only by way of example, the % required may be different.

Oysterbabe · 13/10/2019 08:50

It costs very little to take someone to small claims court so probably worth it.

Hahaha88 · 13/10/2019 09:01

How about you don't be a dick and just pay what you owe, you know like a decent human being?

BilboBercow · 13/10/2019 09:12

OP it's very likely they'll have set up a continuous authorisation on your account. Check your Ts&Cs. If so even if you cancel the card or even close the account, the card payment will be taken.

Aridane · 13/10/2019 11:43

No, it won’t- if OP directs bank not to and they still make the payment, they are obliged to reimburse her. See the link to advice from CAB on this very point in my earlier post
