To expect NC parent to continue paying child support

DD didn't get the grades she needed for uni so is back at school taking the final year again. She will be 19 in July 2020.

Does anyone know what the position is with child support and whether it continues if they take another year? I have reinstated her child benefit so she gets the £80 a month towards her fuel costs but I'm not sure if it's the same situation with child support.

We have an overseas order through REMO (-absolutely useless bunch of *$%!-) and they cancelled the agreement the minute she finished Yr 13. Shame they didn't act so quickly when it took me 7 years to get it in the first place but hey ho, that's a different story.

Thanks anyone who can help.

p.s. no contact with father who refuses to give her anything other than what the court demands.

So she's 18 now? Sorry, but I think at her age she is considered an adult and therefore outside the remit of child support.

I assumed if she was in full-time secondary education that she would still be eligible? She works a few hours for pocket money but isn't financially independent.

Well try speaking to the CSA, I may be wrong but I believe they cut off child support at a certain age, regardless of whether they're financially independent or not.

Just found this on a child support site:

Under current child support legislation, child maintenance is usually paid until a child reaches 16 years old, or until they reach 20 years old if they are in full-time, non-advanced education

So I guess that answers my questions. Thanks anyway.

That's incorrect I'm afraid - when the child turns 18 the maintenance stops (legally speaking).

ChilledBee · 30/09/2019 18:29

AFAIK it isn't incorrect but might be different when it is overseas.

@HavelockVetinari you're wrong. Maintenance is payable until the end of August after the child turns 18. My son is September-born and will receive child maintenance until almost 19 years old.
