To ask to be signed off work until Reasonable Adjustments have been made?

I have a disability and have been working for my current employer for a year. They’re a massive business and really good to work for.

I had an occ health phone assessment in May and was deployed to another quieter branch after a flare up at work (spinal injury disability).

I had a workstation assessment in June and was recommended auxiliary equipment to as a reasonable adjustment. Our occ health providers have changed and it seems like my referral/report has not been actioned.
It’s now been 3 months and the lack of appropriate equipment (new workstation) is having a massive knock on effect on my health and work.
I’m off for an operation next month and worried that my recovery will be hampered by the lack of Reasonable Adjustments. Plus i’m in pain sitting at my desk.

I’ve contacted my union but not heard anything back yet and have spoke to ACAS who gave me the steps to take.

Would it be legal to ask to be signed off work until the RA have been made?

I love my job, the people are great, the management are lovely and I want to work here until retirement so don’t want to go the route to tribunal if I can help it.

I’ve posted on Employment Matters but AIBU is the shizzle.

Not sure where you would stand legally.
Have you been in touch with access to work. You make the referral yourself with your employer and they come out and do the Assessment. Might be worth a try and it would save your employer some money if access to work do the adjustments

If your managers are so great then why don't you just speak to them? Just speak to someone. You've spoken to your union and to UCAS. Who have you spoken to in your actually company?

AliceAbsolum · 25/09/2019 20:26

Yanbu. I'd also meet your manager and HR again to raise it.

Farfarfaraway · 25/09/2019 20:27

Sorry finished to early- so your employer would prob be on board if it was saving them money. I have had a friend just go through the assessment and it was all done and dusted in three weeks and she got the equipment she needed very quickly

I too work for a very large company. It took them 11 months to sort my RA (which was just buying in a piece of furniture for me) so be prepared if you do go off sick.

QueenArseClangers · 25/09/2019 20:36

Yeah, I’ve spoken to my line manager who hadn’t heard anything (plus my line manager changed part way through the process) and I’ve now contacted my area manager.
@Lulualla

I feel like I’m treading a fine line between keeping a good relationship with my employer and protecting my health.

I only contacted union/ACAS today and included that detail as posters are ALWAYS asked if they’ve spoke to their union etc.

I’m big scared and frustrated as I want to do my job without risking my wellbeing.

Legal? I don't think legal is the appropriate word here. What law would you think you were complying with?

Have another chat to HR and tell them you are really struggling and can't continue to work until the 'reasonable adjustments' have been made. They will, presumably, check with Occupational Health and verify your needs and get on with implementing the adjustments.

I think any GP will provide recurring doctors' notes under the circumstances.

If you don't go off sick and are managing, your employer may consider the adjustments aren't necessary.

This is exactly the problem.

dietcokemum · 25/09/2019 20:52

GP here and if I were our GP I would write a 'may be fit to work' note that says 'fit to work when (insert reasonable adjustments) have been made and not until then and I'd do it for 3-6 months.

dietcokemum · 25/09/2019 20:52

your GP not our GP!

@Idontwanttotalk

Reasonable adjustments are covered under the 2010 Equality Act.
