Hi,

Quick HR notice period question for anyone who can help!

I’ve handed in my required 1 month notice at work. Due to holidays, this would mean that I’m in work for the next 2 full weeks, on holiday for a week, then back in for the final week.

I want to work this full month because I don’t want to lose money. I mean, ideally, I’d be on gardening leave (I’m going to a competitor), but that doesn’t seem to be happening. I stated in my resignation conversation and formal letter that I would like to work this full month’s notice.

Today, my boss says that there’s no point in me coming back after my holiday, and to finish up next week instead. I don’t want to do this if I'm going to lose out.

If he is forcing me into finishing early, is the company compelled to pay me for the final 2 weeks of my notice period?

I’m in Scotland if that helps.

Yes, they need to pay your notice.

Ask them to clarify in writing that they are placing you on garden leave - remind them that you have given one months notice and expect to work it, or be paid, and that you don’t agree to cut your notice period short.

You’re not asking an HR question you’re asking us to read your boss’s mind Wink

Ask him to clarify whether you’ll still be paid the full notice period if you do this. Ask in email and cc HR so you have the record.

Then you’ll know whether you have a problem or not!

You owe them the notice, not the other way round. They can say no thankyou to you working it.

How many days holiday will you have accumulated up to your leave date? Perhaps you actually have 10 days to take, hence the early finish?

Hi all, thanks for all your help.

Finally sorted it out yesterday and am going on gardening leave next week, but will be paid in full until my official leaving date.

Turns out that my boss wanted to take a holiday, so he'd decided this end date and termination of salary without having spoken to HR Hmm. I spoke to them yesterday and they were not impressed. I'll be paid in lieu of service now Grin.
