Can I get a refund?

I bought an item brand new on an outlet site. The product itself has a design flaw where it catches on clothes etc and then becomes unusable.
I emailed the company and have explained the issue. They said because I didn't buy it from their official store that they can't help me in any way.
I can't use this item as it's faulty.

Your contract is with the retailer you bought the product from eg the outlet site. Is it based in the UK?

"Accepting returns and giving refunds: the law

You must offer a full refund if an item is faulty, not as described or doesn’t do what it’s supposed to.

Check when you have to offer refunds and accept returns.

Customers have exactly the same rights to refunds when they buy items in a sale as when they buy them at full price.
When you don’t have to offer a refund

You don’t have to refund a customer if they:

knew an item was faulty when they bought it
damaged an item by trying to repair it themselves or getting someone else to do it (though they may still have the right to a repair, replacement or partial refund)
no longer want an item (eg because it’s the wrong size or colour) unless they bought it without seeing it

You have to offer a refund for certain items only if they’re faulty, such as:

personalised items and custom-made items, eg curtains
perishable items, eg frozen food or flowers
newspapers and magazines
unwrapped CDs, DVDs and computer software

Online, mail and phone order sales

Online, mail and telephone order customers have the right to cancel their order for a limited time even if the goods aren’t faulty. Sales of this kind are known as ‘distance selling’.

You must offer a refund to customers if they’ve told you within 14 days of receiving their goods that they want to cancel. They have another 14 days to return the goods once they’ve told you.

You must refund the customer within 14 days of receiving the goods back. They don’t have to provide a reason.
Repairs and replacements

If a customer has ‘accepted’ an item, but later discovers a fault, you may have to repair or replace it. The customer can still reject the item after it’s been repaired or replaced.

A customer has accepted an item if they’ve:

told you they’ve accepted it (having had enough opportunity to inspect the item before confirming they’ve received it)
altered the item

You must repair or replace an item if a customer returns it within 6 months - unless you can prove it wasn’t faulty when they bought it.

You can ask a customer to prove an item was faulty when they bought it if they ask for a repair or replacement after 6 months.

Customers have up to 6 years to make a claim for an item they’ve bought from you (5 years in Scotland)."

Sorry, it was an online outlet store, who directed me back to the original company.
I just want it fixed so it doesn't catch anymore. They can't offer any suggestions on how to fix it. I've just checked my email and they said since I bought it at an outlet store, they can't do anything but they will give 15% off a stronger product which doesn't have this particular issue.

Thank you for all your help and posting links etc. I wouldn't have known where to start!!

If it was expensive and worth the hassle you could go through whatever provider you paid through such as PayPal, credit card or bank to seek a refund if it's faulty.

Your contract is with the retailer not the brand company.

Retailers don't generally offer repairs, as they've not manufactured the item. That's probably why they've referred you to the manufacturer, as they may be able to offer technical advice.

Your legal rights are against the retailer, but if you're looking more for advice, then it can sometimes be helpful to speak to the manufacturer.

As you bought offline you have the '7 days distance selling', I work for a online company and that's standard with all companies? So just return it for a full refund :)

@Mumofone1862 i think OP has already worn it so won't be able to return, thats why she is trying to do it as faulty

They've just emailed me saying that even if they sent me another (I didn't ask for another btw) that I would still experience the same problem and that they would only offer me a discount (15%) and that there is nothing more they can do.
I can't wear it or use it and I'm out of pocket?

As far as I know of an item is faulty then the seller has to take it back - doesn’t matter if it’s in the sale or anything like that to I think the same would apply for an outlet store.
