Claim flight compensation cancelled flight ??

hollyhee111 · 13/09/2019 23:54

Hi all - my dads flight was cancelled ( British airways ) Heathrow - South Africa . It was due to fly Tuesday 10th but got cancelled to Wednesday the 11th 7.05 pm , he went to London to then be told it was delayed until Thursday the 12th 9.50am . He was told about the initial cancellation 15 days prior ( so I understand no refund probably ) BUT would he be entitled to full £540 compensation based on the flight that was delayed on the Wednesday ?? They did put him up in a hotel etc . But looking online I'm a bit confused where he stands

What was the reason for the delay?

SofiaAmes · 14/09/2019 00:22

I tried recently to claim compensation from Norwegian Airlines for a severely delayed flight. My travel insurance paid for the hotel, so clearly thought it was legitimate, but Norwegian claimed that the delay was from "extraordinary circumstances beyond their control" (ie the grounding of the Boeing Max8 planes 4 months earlier). The kicker is that apparently they don't participate in the EC's Online Dispute Resolution platform so there is no way to dispute or appeal their decision. Presumably BA is a little more accountable/responsible in this regard.
Please do buy travel insurance always!!!

hollyhee111 · 14/09/2019 07:28

Thanks both - the reason was the pilots are on strike

Bott & co solicitors have a form hou can fill out, gives you an idea straightaway as to whether you are entitled to compensation. Add a dummy e-mail if you don't want any further contact. www.bottonline.co.uk/compensation/flight-claims/flight-delay-compensation?utm_source=google&utm_medium=cpc&utm_campaign=googlecpc&gclid=Cj0KCQjw_OzrBRDmARIsAAIdQ_JOlBQnZRA5nJmuV4fO16o8YN1j9gJVB3oY9SPT1kOUvfGg143aW1caAjKbEALw_wcB
If he is entitled then make a claim directly from the airline using Resolver. My claim was resolved with money in the bank in around 6 weeks.

SmallPinkBear · 14/09/2019 07:53

Yes he should be entitled to it. The plane was delayed because of lack of staff. It is really easy to claim, don’t go via a solicitors website. BA should have a form on their website to do it

Dontforgetyourbrolly · 14/09/2019 07:58

Hello - severely tired and stressed travel agent here after the week from hell ( thanks BA)
You won't get any compo from BA as they announced the strike in plenty of time and were offering to rebook or refund well in advance.
Sorry to be the bearer of bad news but I've had to do this all pretty much the whole of September.
Please feel free to swear!

BuffaloCauliflower · 14/09/2019 08:08

@Dontforgetyourbrolly sorry to take over the thread - but I see there’s additional strikes planned for the 27th, I’m flying on my honeymoon on the 1st of October, BA from Gatwick, will I be alright? We haven’t heard anything from BA

BlueChangeling · 14/09/2019 08:27

Taxes are inbuilt as part of the price you pay, if you don't fly the airline doesn't need to give them to the taxman so they can be refunded to you. We got ours back when we missed a BA flight. It's not much but at least it something.

Dontforgetyourbrolly · 14/09/2019 08:58

Buffalo, there are rumours of further cancellations oct , Nov and Xmas! Not been released yet . We are advising passengers to book alternative carriers if they can. If you have already booked BA , speak to your travel agent or tour operator to see what their contingency plan is in the event of further strikes.
AFAIK 26/27/28 Sep are subject to cancellations , i think you will be ok as 1st Oct is too close to these dates to be affected . They will need flights running in the fortnight after the 27th to reprotect their passengers.

ContinuityError · 14/09/2019 09:05

You won’t get compensation for strike action (did try that with the recent SAS strike but you get the “reasons outwith our control” response) but the airline does need to cover the cost of accommodation and meals during delays.

Did claim recently for a delayed flight with EasyJet, got confirmation within 10 minutes that they would pay out and money was in the bank a couple of days later.

Dontforgetyourbrolly · 14/09/2019 09:08

I can categorically tell you now that BA will not give you a penny for meals or accommodation during any delay linked to the BALPA strike .
They didn't make 4 billion in profit last year by being fair. The only way to move forward is to travel with alternative carriers from now on .

ContinuityError · 14/09/2019 09:15

If OP’s dad’s flight was rebooked to the 11th and then delayed to the 12th, they weren’t official strike dates though?

SAS paid for accommodation and meals for our delay, plus the cost of rebooking.

LtJudyHopps · 14/09/2019 09:15

Dontforgetyourbrolly I have a question (sorry OP) - my flight was delayed for 5 hours as the inbound flight we were waiting to return on had disruptive passengers the police had to remove. Then the flight crew were going over their hours so they had to get emergency crew. The inbound flight was re-directed to another airport so we had to be sent to that airport to get the flight home. Are we entitled or is this out of their control? It was Reus (then became) Barcelona > Stansted

Dontforgetyourbrolly · 14/09/2019 09:22

Judy sounds like your flight was with Ryanair. They participate with the eu compensation so you should try , although they will do their best to get out of it ! Ime easyjet are the fairest.
With regards to the op's father it makes sense that he should receive comp in that situation so definitely try - it doesn't cost anything to give it a go. However they will argue he was offered a refund initially. I'd advise any one to try, the form is on their website - well hidden

Hangingwithmygnomies · 14/09/2019 09:23

I work in the flights department for a tour operator so @Dontforgetyourbrolly I completely feel the pain lol! I spent all day yesterday reprotecting people onto alternative flights. @ContinuityError the 11th wasn't an official strike date but was likely to be an operational decision due to the after effects of the strike. OP it's extremely unlikely he will get comp under regulation EU261 as industrial action is not something within the airlines control.

Dontforgetyourbrolly · 14/09/2019 09:24

Continuity, SAS are a lovely airline and fair to their passengers. Their call centre is based in Scandinavia and the staff are helpful and knowledgeable. BA call centre staff struggle to answer anything they don't have scripted , it's beyond frustrating

Hangingwithmygnomies · 14/09/2019 09:25

Link to BA flight cancellation as always worth a try. The worst they can say is no www.britishairways.com/en-gb/information/legal/flight-cancellation-compensation

GreenTulips · 14/09/2019 09:25

All the airlines have direct claim forms you need the flight number and date. It doesn’t take long to process.

Dontforgetyourbrolly · 14/09/2019 09:27

Hanging, I wonder if now some of the passengers that told us we were too expensive regret their decision to book that flight they saw a tenner cheaper on line??
This week I've started work at 7.30 am a d worked through my lunch break. We charge booking fees because we don't work for free x

LtJudyHopps · 14/09/2019 09:27

Dontforgetyourbrolly it was Jet2 - they seem pretty fair but I haven’t had a problem before!

Hangingwithmygnomies · 14/09/2019 09:28

@Dontforgetyourbrolly I depise having to talk to Rapport - costs you a fortune to get through and then they stick to the script so you don't get anywhere! The general public line wouldn't talk to me about my own booking as I'd not yet put APIS in and kept telling me to do to my travel agent, not understanding that I was the travel agent 🤣

ContinuityError · 14/09/2019 09:29

I’d give it a try anyway - the MSE website section is helpful and has links to the airline website complaints / claims sections.

Dontforgetyourbrolly · 14/09/2019 09:31

Judy Jet2 are great u must try

Hangingwithmygnomies · 14/09/2019 09:33

OP just a thought - was the flight on 11th delayed until the 12th or was it cancelled and he was rebooked to the 12th? If the fligh was delayed, did they tell him why?

ContinuityError · 14/09/2019 09:37

Dontforgetyourbrolly SAS were awful, although TBF they were probably inundated with grumpy customers. Despite repeated promises to book him an alternative flight, DH eventually had to sort himself out - SAS eventually offered him an alternative flight 4 days after the cancelled one (and that would have been 3 days after he actually arrived home).
