No drop curb no drive?

3 new build houses (clusters) opposite my house, the road is narrow and you can only park on one side of the road.

One of the end houses has a drive with a dropped curb, the middle house and end house have no drop curb but same driveway as they are all identical.

The person who rents / owns last house is parking his car on his drive but it has no dropped curb, therefore I've parked my car in front. Not totally blocking as there is enough space for them to squeeze out, usually 2 cars can park on the space but that would mean totally blocking his drive.

AIBU to park there if the space is free and there is a dropped curb?

If his car is in the drive? Yes that would be a dick move.

If his car isn't in the drive then I think legally it is fine as there is no dropped kerb, but from a neighbour point of view I think that is also a dick move

I think legally you are right but I probably wouldn't do it. They have a driveway and these houses are new builds so it sounds like a really weird flaw rather than just a random person paving their don't garden and trying their luck.

Legally you’re in the right but I would feel very bad parking in a way that makes it awkward for someone to get out of their drive/parking space/dig up garden.

If you want to make sure that he never gives you any assistance or latitude when you might need it, this is a great way to proceed.

Otherwise, don't treat your neighbour like this. Help him to ask the council or developer why dropped kerb has not been placed in front of the driveway of his property.

Legally you're right. Front gardens that are paved over for parking without a drop kerb aren't driveways.
I'd guess it's a builders oversight and mistake given they're new builds and I think new builds have to have some sort of off road parking now in most circumstances.

However, the intent is perfectly clear and you say yourself they park on their drive so parking over it is a bit of a dickhead thing to do.

Fair enough I've moved my car, the middle house has a lamppost on the pavement so the developers were not allowed to drop the curb got that one and the last house.

I feel the need for a diagram Grin half cut on wine now

With regards to the lampost then the developers have screwed up there. I could have sworn I'd read somewhere that new builds have to have off road parking most of the time.

Townhouses are awful for parking at the best of times. We lived near a block of townhouses and there's always more cars than drive space, which means jostling cars on the road and a bloody nightmare when anyone had visitors. I'd never want to live in or near a block of them again.

If there is no dropped kerb it is actually illegal to drive across the footpath.
It's wrong that a drive should be put in without applying and paying the council for the dropped curb.
But if you want to be a good neighbour you may just decide to leave the access clear.
