Parking and Blocking Driveways

Shewhomustgowithoutname · 12/09/2019 02:05

I am so angry about vehicles being parked in such a way that I can not get out. There are other driveways on my side of the street but no one else seems to have cars parking over their driveways.
I have heard that previous people in this house had multiple cars which is why there is a parking place on one side of the front garden and a driveway leading to the garage at the other side.
I got so fed up with being blocked in that I asked Police to assist. I sent them photos and some officers have called and seen the blockages. They did not do anything about the recent spate of parking. They may have spoken to one repeat blocker. I have to be able to go out when I need or want. I work and I have a child. I dont think I should be blocked in like this so often.
Do you think Police should have helped me to be able to go in and out of my property whenever I want.

Please stop driving over paths.

@Shewhomustgowithoutname @Unknownanon @supersara

To be clear about 'the neighbour's disabled space', it's not HER space.

It's free to be used by anyone permitted to use disabled spaces - i.e. anyone holding a blue badge. Even if that's some entitled sod parking there who could have easily parked elsewhere.

Them's the rules

Sort of... Disabled bays outside houses are usually only advisory in nature.

It's rare, but not unknown, for a residential disabled parking bay to be covered by a traffic regulation order. Without a TRO, no active enforcement will take place and in such situations there is nothing stopping anyone without a blue badge from parking in a dis-bay apart from their own moral fibre.

bluebeck · 14/09/2019 11:45

OP YABU

You do not have a dropped kerb therefore you have no right of access to those parking spaces.

It doesn't matter if you are male or female, or how many parcels you take in for neighbours, it doesn't change the facts.

Shewhomustgowithoutname · 14/09/2019 11:58

I can get the dropped curb without much bother however I do hope it would not be a waste of time and money because of the local disregard of laws.
As far as the back area where a garage was there are legal regulations over that. According to the Highway Code no one should park to cause any obstruction.

The point everyone is trying to make is that what you currently have is not enforceable. However once you get the dropped curb you can have their cars removed if they block you on to your drive (not if they block you out though). Again with the disabled bay, these are courtesy bays and not legally enforceable unless they have the correct signage.

Refusing to get the curbs dropped will mean they keep on parking and obstructing you. If you get the work done you can then have their cars moved.

If you don't have the kerb dropped then no-one is disregarding laws - you have no legal access rights.

zebra22 · 14/09/2019 15:43

YABU get your kerbs dropped

Blueandredandblue · 14/09/2019 18:34

I have a dropped kerb and have had ongoing problems with people blocking my drive. In my area you call the parking enforcement and they get a fine. This hasn't endeared me to the few neighbours that insist on blocking me in or out of my drive, but I've tried asking nicely and they get worse.
Get a dropped kerb, try one and see what happens.

StillMe1 · 14/09/2019 18:49

I will get the curb/kerb dropped and see what happens.
Thanks everyone

RebootYourEngine · 14/09/2019 18:50

I would get the kerbs dropped because then you have more legal rights.

dexterslockedintheshedagain · 14/09/2019 20:27

Name change?

Shewhomustgowithoutname · 14/09/2019 21:25

@dexterslockedintheshedagain

That is more interesting than just a name change! LOL

Lol! I'm just a tad confused! The way the poster wrote it sounded like she was the original poster under a new name!
I had a similar situation, so got the kerb dropped. Stopped people parking right over our drive, now they just park right up to the beginning of the drop Hmm

Shewhomustgowithoutname · 15/09/2019 20:25

@dexterslockedintheshedagain

I was confused myself till I worked out what happened. Someone called at my house asked to use laptop. Didn't cover their use over.
I will get the curb dropped and watch what happens. Definitely wondering about the type of persons around me. I dont like this type of attitude. Other reasons alongside the parking situation

I don’t understand this at all?!

MsPavlichenko · 15/09/2019 20:28

It is kerb not curb.

YouJustDoYou · 15/09/2019 20:35

It's illegal to drive over a raised kerb. "If you intend to drive a vehicle over the footway into your driveway off a highway, then you will need a dropped kerb. If you do not have dropped kerb, you must not drive over the footway. If you do so, you are breaking the law and enforcement action could be taken to prevent such practice. Furthermore:

You may become liable from a collision with a pedestrian
You may become liable for damage to the footway
You may face considerable costs as a result of damage to any utility apparatus under the footway"

And so on.

karenbokaren · 15/09/2019 20:36

It is kerb not curb.

@MsPavlichenko not if you're in America or Canada.

Shewhomustgowithoutname · 16/09/2019 06:18

As I have been told and it appears to be true the front was only used after repeated blocking of the approach to the former ancient garage.
If the garage had not been blocked in the past and currently it would probably still be in use.
The point is that there are 3 different places to have a car off the road but they are frequently blocked. Is that a fair way for other residents to be? Would these residents be happy to block in a large Male? Or is it because I am a quiet female with a DC?

OP posts:
OoohRhubarbLetsGo · 16/09/2019 07:08

It’s because you don’t legally have actual driveways. You’re lucky the council hasn’t begun proceedings against you for illegally driving over the pavement to access your property, which happened to a former neighbour of mine.

You need to pay for dropped kerbs, after which the police can act if you get blocked in.

fedup21 · 16/09/2019 07:13

Or is it because I am a quiet female with a DC?

No, it’s because you don’t have a dropped kerb.

ComftyCushion · 16/09/2019 11:11

OP you have been told numerous times by numerous posters that you are BU and you are in the wrong. Get over it and get your kerb dropped. Once your kerb is dropped, if the problem continues you can come back and moan as much as you like. Stop trying to be a professional victim.

leaserspottedmummybird · 16/09/2019 15:03

Put out cones or something op or a 'please don't park here' or 'private driveway' signs

Shewhomustgowithoutname · 16/09/2019 15:48

Been in contact with the council re extending the dropped curb. Also getting a white line. Council advised me that even then people will likely park as they do now. They are so desperate about parking it is getting really silly now.
Cones out for street painting and other major works to the street by the council didnt get them to vacate parking places. Bin lorries and emergency vehicles with blue lights dont get through here without problems

OP posts:
leaserspottedmummybird · 16/09/2019 16:05

Put 'don't park here' notices on the offending cars or get together with the neighbours to get the clampers out.
