Parking ticket!

nottoday3000 · 07/09/2019 13:58

Hi any advice please, my son works for a well known supermarket, last Sunday, I drove intro the supermarket car park and waited for him to finish. He should of been out by 1pm however he had a spillage at work and never left till 120pm 🙄I've now got a parking ticket for this do you think I've got grounds for appeal ?? Just seems harsh as he works for the company although I take it post car parks are privately owned

If you notify the supermarket and explain they should take away the ticket through the company like Parking Eye or whatever it is!

Also remember you don't have to pay private tickets - Money Saving Expert has the info

@duvetsay thanks for your reply can't get through to the actual store spoke to the regional phone number ! And was told I needed to speak to euro car parks ! I've put an appeal in so I'll wait and see !my son picked up a massive box of coat hangers and the bottom fell out so he had to pick the whole lot up meaning he was late !! Bloody kids it's his fault !!!!

They should help - if you go into the store you can also find out.
I got one picking someone up from a Holiday Inn, I googled the specific one and parking ticket and found some complaints on trip advisor. The hotel had responded with an email to give your licence plate number to get rid of the ticket. Maybe try that?

ElizaDee · 07/09/2019 14:13

Why would a supermarket give you a ticket for being in their car park for 20mins?

What are they saying you did?

nottoday3000 · 07/09/2019 14:23

@ElizaDee I think it was because they photo your reg as you enter and it's a ticket machine you need to put your reg! so obviously I never got a ticket because my sons normally out after 5 mins it's just a bitter pill when my son works for the store 🙄🙄

This is old advice. Private fines need to be paid unless you want a CCJ.

Drogosnextwife · 07/09/2019 15:04

Not in Scotland. I'm absolutely certain private parking tickets can't be enforced here. I've got a few. We'll jot me my partner. Ive got one from about 5 years ago, nothing has ever been done accept letters.

FrenchSchnoodle · 07/09/2019 15:18

Please please ignore the advice stating that you don't have to pay it because it's been issued by a private company. Its rubbish.

The supermarket probably won't be able assist you with the appeal.

The Fine was correctly issued in that your car was parked without payment. So, the supermarket could confirm what time your son left the store and that he had an unexpected duty to take care of but the company will probably argue that unless he is literally standing outside the doors, you should always pay to park or park elsewhere and let him walk to the car. The point being, you can never guarantee what time he'll appear and so even if it's 2 mins that you're parked for, you're parked illegally. In asking the supermarket for help/proof you're actually confirming why the company were correct to issue a Fine. You're making their argument for them.

froggybiby · 07/09/2019 15:47

Go and see the supermarket yourself. I parked in Morrisons car park & was issued a ticket. I had paid 4 my parking & had the ticket...I was still within the limit. I am unsure what happened as there was a space for reg plate on the ticket however mine wasn't on despite entering it. Luckily, I still had the ticket & I called the store. I was told to come in & speak to the duty manager. When I went in, the lady was able to log on a computer & void the ticket there and then. Good luck. Call them to explain.

BeanBag7 · 07/09/2019 16:05

Our local supermarket use parking eye.
People regularly post on facebook after getting a ticket. The response is that if you go into the store with your receipt the store manager will clear it for you - I assume they contact parking eye. You (or your son) could probably talk to his store manager about getting the ticket removed.

However, I do think it is a bit silly if you to not realise you were in the car park for over 20 mins and would need to input your registration. Maybe you could get your son to just do this on his way out of work each day just in case.

nottoday3000 · 07/09/2019 16:27

Update: my son went back in to his store and spoke to his manager he has taken a photo of the fine and is going to speak to them we shall see thanks for all your replies and advice this was my first post and I was a bit scared ! But I am grateful thanks for breaking me in to MN gently xxx

My DH works in a supermarket and received a fine after taking my car instead of his. He sent evidence to the car park enforcers and they cancelled it.

duvetsay · 08/09/2019 01:07

@ThatssomebadhatHarry no it isn't, you can still not pay but just go through the normal battle. If you were ever going to go to court then of course you'd pay. People act like it's easy to get a CCJ when there's so many stages to it and as long as you keep your head above water, you won't get a CCJ

BarbaraofSeville · 08/09/2019 03:05

Yes, the best thing to do is to try and get the supermarket to cancel the ticket as the chance of winning any appeal directly with the parking ticket is close to zero unless you want the hassle, stress and inconvenience of taking it all the way to court in the hope of getting magistrates? with common sense to see your side.

I got a ticket in similar circumstances, I sat for 10 minutes in a nearly empty car park waiting to pick DP up from the station as it was the only safe place to stop and his train was delayed. I didn't even get out of the car and I can't believe anyone would think to pay in those circumstances. I tried to appeal with the parking company and even offered to pay the £2 I should have paid and obviously they weren't having any of it, so I decided the best thing to do was pay up.

yellowallpaper · 08/09/2019 10:21

No, DH had one of these. parked in a private car park which was deserted. Miles of empty spaces and no obvious signs (though he never looks!).

You entered into a contract by parking your car there, even if you stayed in the car, so just pay up.

It's a mistake you don't usually make twice....although DH does it repeatedly. Confused

ElizaDee · 09/09/2019 14:08

I stayed in a travelodge that had a permitted car park. We forgot to put the permit in the window and received a fine a few weeks later. I ignored it. Got another one a few weeks after that threatening all sorts. Ignored that, haven't heard anything since, and this was a year ago.

Exactly this - ignore any and all correspondence from them up until the point you receive an actual summons. They will send increasingly official looking and threatening letters claiming to be from solicitors and debt collection agencies. Bin the lot, they have no official weight at all. They will usually (eventually) give up.

Parking companies make their money from relying on, and in some cases scaring people into, paying the charges they demand. It's really not in their interest to take people to court for a £100 fine, it's expensive and time-consuming.

The important bit is not to respond to any of the correspondence in any fashion - no replies, no offering reduced payments. You are under no legal obligation to acknowledge any of it.

Obviously this advice only applies to private parking company "charges", not to actual council parking fines etc. You do need to respond to those !

ElizaDee · 09/09/2019 14:48

I heard the other week, that there is a little known law where if you send the unopened fine back to the council with a note to say you don't acknowledge it, they can't make you pay it.

I don't know how true that is though. If it were true, Martin Lewis would be telling everyone about it.

FrenchSchnoodle · 09/09/2019 15:20

Eliza that's not true at all.

I think that you're also confusing council issued penalties with those issued on private land.

It used to be thing that people did with Fines issued by private enforcement agencies. They'd send it back with a £1 coin and state that the coin representated the true cost of parking in the car park and so they were happy to pay that but no more. Anyway the legiation changed a few years ago.
