Wondering if I should be paid for KIT days

I’ve read online that employees should be paid for Keep in Touch days that they work during maternity leave, however my employers policy suggests that they don’t think they need to. I am getting enhanced maternity pay. Does that make a difference?

Pretty sure it doesn't make a difference, as long as you take the KIT days after the enhanced maternity pay has ended. So if you get paid in full for 6 months for example, there's no point taking them in that first 6 months. I think that's how it works.

My mat leave pay is enhanced throughout.

This seems to say it depends on your employer! I know thatbteachers I have worked wi have not taken kit days whilst still being paid their mat pay, as they would not get paid extra for them. They take them after mat pay ends.

Kit days increase your pay from your smp/or whatever up to full pay.

So thay have to pay you the difference.

30% isn't full pay so yes, you do get paid for KIT days - they are there partly so you can 'top up'. So you employer pays you a full day, not just 30%.

You are paid 100% of your pay for each KIT day so yes your employers should be paying the extra 70% for each KIT day - they are very useful!

You need to be paid but the actual law doesn’t say how much. Individual employers policies would dictate that. If you are already on enhanced pay you probably won’t get any more money for kit days - but that’s an assumption of mine not a fact .

Hi i don't know who you work for but the NHS pays full pay for KIT days. May not be helpful to you

Employees can work up to 10 days during their maternity, adoption or additional paternity leave. These days are called ‘keeping in touch days’. Keeping in touch days are optional - both the employee and employer need to agree to them. The type of work and pay employees get should be agreed before they come into work. The employee’s right to maternity, adoption or additional paternity leave and pay isn’t affected by taking keeping in touch days.

Hi, HR professional here. You should be paid your normal pay for the days/hours you do. Many employers will have you in a shorter day but pay as though a full day worked, others will pro-rate it for hours worked.

I also thought KIT days aren't mandatory I.e they cant make you go in. So if they're not going to pay you then dont bother.

I think some places don't pay you for them but give you the time back in lieu - are your workplace doing that instead?

If you have a period of unpaid maternity leave you are best to do kit days then as you actually get paid.

Hi, I worked in payroll. For KIT days we would pay the employee their normal hourly rate for the hours worked but then deduct the equivalent amount of time from maternity pay.

E.g. you work 7 hours you get paid 7 x your normal hourly rate minus 7 x your hourly rate for maternity pay

That way you don’t get paid twice if that makes sense
