To want a refund.

Dh and I had day tickets for a festival yesterday. Due to the horrendous weather(extreme high winds) at 12 o'clock the organisers updated their FB page saying the opening time had been pushed back to one, at half past one pushed back to four, main stage cancelled but smaller acoustic set going ahead, at 4 event completely cancelled.
All Saturday ticket holders can go today but we have a prior commitment. Completely different bands on today none of whom I want to see (not really relevent though)
Should we be given a refund? Tickets were £50 each.
T and C's seem to suggest that they should refund but the organisers won't reply to questions, although to be fair they are pretty busy with today's festival.

Just to add: they may decide to offer to transfer the ticket for next years event, so they do not bankrupt themselves...

MulticolourMophead · 11/08/2019 15:39

They may have insurance which covers this sort of thing?

If they don't have insurance, they deserve to go bankrupt. Public Liabiity insurance at the very least. I organise events at a school, and having checked, we are covered under the school's insurance as we are doing things on behalf of the school. Otherwise we've have had to arrange insurance ourselves.

DustyJigsaw me and my dh were in The Castle then the Man in the Moon in Newport. We came into Newport(we live about 12 miles away on the Island) hoping they would open the site at 4. The organisers were so upbeat in the run up to Saturday but that wind was savage. Were you dressed up?
I'd be happy to take a transfer for next year.

The weather wasn’t their fault. I wouldn’t expect a refund.

Nor was it the OPs fault.

It was bad luck but they will have still had the same costs.

What on Earth does that have to do with the OP? If I stopped going to my job I would have the same living expenses but my job would stop paying me.

Requesting a refund because of completely uncontrollable circumstances is the kind of thing that would make a small festival go out of business.

It might. It could be that they massively profiteer. It could be they just planned sensibly for an obvious possibility.

I think it's bizarre to suggest OP should not exercise her legal rights over a service not received based on imaginary scenarios. Plenty better causes if you want to donate money.

Costume?

Izzabellasasperella · 11/08/2019 16:36

I'm a fancy dress fanatic😀 I know that's a bit frowned upon on MN. So I was wearing full on 1980s Madonna ish costume!
Lots of people dress up at this festival.

We were in the man on the moon and I saw a madonna lookalike with lots of necklaces, black top and back combed blonde hair, so perhaps that was you 😎.
I'm afraid we didn't dress up, but dressed up for the windy weather!
The more I read comments, I'd be surprised if they were not insured and It looks as though they legally need to give us a refund. I hope so, as just don't want a battle on my hands to be reimbursed!

Izzabellasasperella · 11/08/2019 19:06

Let's hope they do refund I'll update when I find out any information.
My hair is black. This was me yesterday 😀

I looked at the photo and thought it was Madonna Wink.

You may have received the same comms as us, but they said that their t&cs clearly state no refunds; they have been overwhelmed by the amount of support and thanked a large amount for being generous and would happily forego any form of compensation by not asking for a refund to save they bespoke event!

I personally feel the text is written to try and shame anyone that asked for a refund, but we all have our own finances to think of too and can't just afford to give £100 (for 2) away - and to incur another round of travel expenses for next year. It cost us £200 to get to/from & stay on the IoW as it was.

Anyway, they have said to hold on to our tickets and we can use it for next year's festival, as they hope to sign up the same bands - so we are just waiting on dates.

All in all, we are fairly happy with this outcome, but their email has left a little sour taste, as seems all a bit woe us and about their finances and safety (correct, although with a better staging structure, I imagine this could have been avoided) and what they are generously going to do to rectify the situation! There was no acknowledgement or reference of the costs, disappointment or inconvenience the festival goers will have endured.

Izzabellasasperella · 15/08/2019 19:43

Yes I got that email. For us it's not too bad as we live here and will go next year using our day tickets although dh was grumbling that we don't know whether we will want to.
I do feel sorry for people like yourselves having to pay the extra cost, the ferry prices are crazy.
Lots of posts on fb that like you made me feel a bit guilty about wanting a cash refund☹️
If you make it next year I'll be wearing the same costume so if you spot me come and say hello😀

Daughter was at a festival a couple of years ago and it got rained off after the first night (so entire 2nd day of 2 was cancelled). They gave refunds of half the ticket price (even though the Friday was evening only so technically not actually half the concert).
Anyway we had to send the tickets in and she and her friend had had them in their jeans pockets. So I sent all the pieces - most of each serial number was visible, plus the receipt for payment. And got a refund pretty quickly.
