Parking Ticket on Double Yellows!

There is a loading only area locally outside a health centre, is a very small side road. I was parked on double yellow lines not within the loading area yesterday for approximately an hour during a procedure. There was a double yellow mark on the kerb “within” the yellow lines indicating "no loading". There were other vehicles parked within the “loading only” bay. I displayed my disability blue badge clearly and set my time badge appropriately.

Upon returning to the vehicle a parking ticket was attached

AIBU to refuse to pay this? I even use a wheelchair.

Do you mean there were these lines too which means no parking Even if disabled?

Sounds like it's because you were within 15m of the loading bay.

Hi,

You need to fill in the bit of the ticket which gives reasons for thinking it was issued incorrectly. In most areas you can do this online

I have done this in the past and (eventually) got an email or letter saying that it had been cancelled.

YANBU to challenge the basis on which the ticket was issued. The traffic warden is obliged to take a photograph of your blue badge and clock and will be required to prove they issued the ticket correctly - which they didn't.

I can’t quite follow from your post if these were there or not, I think you say there were but some other vehicles parked there too ? Did they not have tickets ?

You parked in a loading bay... you cannot do that, even with your blue badge! It's a designated laoding bay... for laoding. Just as designated disability bays are for disability holders.

A blue badge doesn't entitle you to park anywhere

Blue Badge holders are not allowed to park in loading bays and may not be able to park in other places reserved for permit holders, like residents bays for example.

As for the other vehicles, maybe they were using it for laod, each one parked for 5 - 10 minutes at atime. Who knows. But your ticket is valid!

You can park 15 m from a loading bay.

But not 15 m from a junction.

OP were you in the loading bay or not? Your OP isn't clear (to me.)

You can park on double yellows for 3hrs with a BB, but NOT within 15m of a junction or loading bay.

Oh! not within the loading bay! Then, as sneaky has said, you were parked to close to it. They are like corners and junctions, there is a deignated safe space round them!

Having a blue badge doesn't allow you to park anywhere though. There are restrictions on parking on double yellows. Sounds like you were too close to the loading bay & you'll have to pay it

Yes @MyNameIsRachel , I was confused because double yellow lines were also displayed on the edge of the carriageway. It's also extremely dangerous in a wheelchair to park on the main road adjacent to this small side road (perhaps 40 metres long) due to a long, steep, gradient.

Unfortunately those yellow lines on the kerb are no parking even with a blue badge not no loading.

If there were double yellow kerb markings then you have no grounds for appeal. An expensive lesson but you'll know to avoid them next time

The loading bay is irrelevant though. You parked on double yellow lines with yellow kerb markings. You cant park there even with a Blue Badge. The ticket was issued correctly & you'll need to pay it

If the yellow kerb lines were there then you shouldn't have been parked there.
I'm not sure you can appeal it.

I have a blue badge OP so I understand where we can / can't park and I'm afraid to say that this ticket was issued correctly.

I'd pay it and now you know for next time Smile
