Aibu to report neighbours

YummyBelicious · 07/07/2019 19:14

OK, so in my street our houses face the back garden fences of the houses opposite.

My opposite neighbour constantly puts large rubbish items outside their back gate, onto the pavement on my street. For eg, dismantled furniture, piles of building rubble, old doors etc. Not in time for rubbish day, just randomly. I have to call the council everytime and report it so its collected. The problem is now a bad cycle of them thinking the rubbish is taken for free by the council, putting more out there, me calling again etc etc

The council want me to give my details properly and report them for flytipping so that they can prosecute. I don't want to fall out with my neighbours... But its so annoying, once its out the back gate to them it's out of site out of mind. I'm sure they wouldn't dare out it out the front of their house!!!

Aibu to ask how to proceed, bearing in mind I don't want to fall out with anyone

Go speak to them? Say you haven't minded calling in so they get free collections so far, but they're pressuring you to give more details now so they can prosecute so stop putting it out. Think I would've gone and spoken to them at beginning tbh

YummyBelicious · 07/07/2019 19:18

Yeah I could speak to them but I feel scared about falling out as last thing I want is to fall out with anyone I love where I live

Surely you just say or write a note to them 'I have had to ask the council x times to remove your rubbish. The council have said next time they will take details and start proceedings for prosecution' If they ignore that give your details and let the council get on with it.

Ponoka7 · 07/07/2019 19:27

The council will give them a warning to start with. They can't prove it was them.

I would see them amd tell them that you've been getting the rubbish removed but now the Council is asking for details and are thinking of installing a camera.

If it carries on, report them.

DontCallMeShitley · 07/07/2019 19:59

You can report to the council and make it clear to anyone that looks on the site by using FixMyStreet. Use the fly tipping option from the drop down menu.

See if that helps. If not, put a note on the rubbish saying 'Property of ...etc.' Or shove it back into their garden.

sueelleker · 09/07/2019 11:03

Where do you live? My council charges for rubbish removal-if it won't fit it a bin, you have to pay.

Thump · 09/07/2019 11:06

But surely the council must know it's them that's doing it - so why haven't they prosecuted them/warned them already? Do they need you as a witness or something?

ThistleDownHair · 09/07/2019 11:07

I'm jealous you get large items removed for free!

I had some large items that couldn't fit in a bin/my car and had to pay £24 for the privilege of having the council pick it up!

Gingernaut · 09/07/2019 11:10

@sueelleker, the rubbish is reported as dumped on the pavement and the council can only clean it up as 'flytipping'.

With an official statement, stating who dumped it and when, the council can officially charge the person with flytipping.

The flytipper clearly isn't going to ring the council and pay if they are getting the stuff taken away for free.

Even if someone from the council asks, all they have to do is say "Dunno. It's always happening, I never know who's doing it"

Without proof, like a witness statement or CCTV footage, there can be no prosecution.

NeonLights · 12/07/2019 00:36

In that case I'd be installing some CCTV.
