To think that the law in US (Alabama) is now insane

A pregnant woman got into a fight and was shot in the stomach. She lost the child. She’s now being held in jail on manslaughter charges because her fetus died when she was shot and the authorities have decided that the shooter shot her ‘in self defence.’

This is a classic example of the inherent hypocrisy in US gun laws. The strong likelihood is that, if guns weren't so easily available, this fight would have ended completely harmlessly. But let's blame the pregnant woman who got shot, not the person who shot her, and definitely not the laws that made it so easy for that person to have a gun.

The person incarcerated is the one who started and continued the fight. She would also be the guilty party in the UK jurisdictions.

Except, without a shot being fired, the shooter could be charged with illegal possession of a handgun! Self defence has to be proportionate - the shooter was not too incapacitated by the attack that she couldn’t take the loaded? gun out of her handbag and use it. I doubt if the victim of the shooting, would guilty of anything in the UK.

You know when you get shot, your baby dies and you’re the one that ends up in prison something is very, very wrong with the ‘system’.

The deep South is hardly renowned for being a part of the 21st century though.

I don't think it was coincidence that the "self defence" shots into her abdomen happened during a fight about the baby's father, do you?

She could be charged with assault which would be unlikely to result in a custodial sentence. But, given what she has been through, that would be highly unlikely.

She would be "a" guilty party for assault, but that wouldn't prevent the other person also being guilty. It's a basic principle that self defence should be proportionate and, whilst every allowance is made for the heat of the moment, someone shooting another person in the stomach five times would have difficulty in claiming that was proportionate.
