To ask the owner to pay me

I work in a small company made up of 3 directors who are the owner and his 2 sons and 3 staff one of whom is the office manager.

We always get paid on the 28th of each month, so on the 27th or the working day before the 27th the manager loads the payments and gets the owner to authorise them and then they hit our accounts on the 28th.

I checked today and there was no wage in my account, I spoke to the Manager and she said she was too busy to load the payments before today and the owner is in a bad mood she does not want to bother him today.

I have direct debits and standing orders that have come out my account today and I just received a text from my bank saying there are not enough funds to make the payments and I would need to pay funds in by 2pmm_ in order for the payments to be made and to avoid charges.

I told my Manager this and she said there is nothing she can do at the moment as she does not want to bother the owner.

AIBU to go to the owner myself and asked to be paid? I do not want to get charges or late payment strikes, I am not really sure where I stand with this.

I don’t really have much dealings with the owner usually he comes and goes and nods or says hello but that’s as far as communication goes with him and I.

What happened with the other two owners/directors? Are they not hands-on with the business? Has someone embezzled funds from the Company, and this is why the immediate Owner was upset?

I think the Manager has handled the situation, whatever it is, very poorly. I would suggest she knows very well what the situation is, and it isn't pleasant, thus her tense reply.

If I were you OP, I would be checking that my deductions such as tax are up to date and have been paid by the Business. If something is up financially, its usually payroll/income tax and the like that don't get paid on time.

Your contract should state which day of the month you are paid. if this falls at the weekend then it would be the working day before this. YANBU is you haven't been paid according to your contract and will incur overdue fees.

Hope you’re ok op? Can you arrange a temporary overdraft or extend overdraft to tide you over? If you explain to the bank I’m sure they’ll help?

If the pay is due no later than 28th then of course contact the owner. You manager should be sacked. Come to think of it why has the owner not realised no wages have been authorised?

Hi Op hope you got paid ... email your manager ( always put things like this in writing)
Inform Mgr you may incur charges for unpaid bills and that as per contract you will pass on charges to company ... also you will need to put a note your credit file to explain why you have defaulted so you are not penalised if asking for credit in the next 3 years

I think this sounds like the beginning of a more serious problem, like the company going bust.

The Manager's excuses that the boss is in a bad mood and that they don't want to bother them are just that - excuses! And very weak ones at that.

If there are serious cash-flow problems being kept from the work force then it'll all be apparent soon enough.

Another former MD chiming in to say paying staff on time is sacrosanct. Once in a blue moon a staff member might be underpaid because overtime wasn't included it was miscalculated, if this happened, we apologised profusely and it was corrected immediately. We had cash flow problems at times, staff were always always paid.
Your manager is bang out of order, or, as others have said, it's about to go tits up.
Alternatively you could be working for my most recent employer, a northern FE college, in which case they are just incompetent cunts.

Yes you should chase it up, but also maybe move your dd's to say 2nd of a month to give yourself a bit of breathing space in the event your wage is slightly delayed again or 28th falls on a weekend or Bank Holiday. Hope you get it (got it) sorted.

I did note a comment that the staff must be paid first and then the suppliers and others can wait.

Course the suppliers are waiting to get paid in order to pay their own staff which they may not be able to do till they get paid;?..

If you have a written contract stating the date you get paid and it's overdue yes you need to contact them in writing so you have written evidence chasing them that's it's broken your contract and you can't pay your bills.

I hope your fears are unfounded. Of course, there was something very simple indeed that the employer could have done to prevent the OP ever having any reason or inclination to post it in the first place. Pesky employees, wanting to be paid as contracted for their work, eh?

sorry for not updating sooner, I have since left this job still unpaid

turns out the company is in financial trouble and they asked us to wait for double pay next month so i resigned there and then.

I have an appointment with citizens advice on wednesday but not holding my breath for my wages any time soon

Oh dear OP. But at least because of the advice given here you got to find out sooner rather than later and was able to cut your losses.
