Neighbour owes me £100

Neighbour owes me £100 but hasn't paid & doesn't look like she ever will either. She wanted to replace her old knackered fence (so far so good) but whilst I was out at work, she dismantled her old fence & then came onto my property & removed & threw away my two independently posted 6ft trellis panels & cut back all greenery on them to stumps. She did this she said, so that there was more room for her to dig proper holes for her new fence posts. Her new fence is up and finished & well constructed, so I have no qualms there but you can't just come onto someone else's land & rip out what you don't like. I politely vented my spleen & she admitted she was in the wrong & we agreed as a gesture of goodwill she'd pay me £100. I was happy with this - only it's never materialised & I realise now it never will!! I'm really pissed off because I feel like I've been taken for a mug. I'm not bu am I?

We she she offered you the £100, why didn't she give you the money at that time?

Did they say when they would give it to you?

What have you done to chase this up with the neighbour?

She 'Didn't have it on her' at the time.. & never has ever since. I'm tired of asking for it now - it's embarrassing. The last thing she suggested was 'How about I just buy you a few new plants instead?' -No, I want my fucking money. She just avoids me now & makes out like it never happened.

Threaten her with a small claims court. She’s lucky you aren’t billing her for the cost of a gardener, new trellis and new mature plants- would add up to much more than £100! Cheeky cow.

I would pop round and ask her, in a friendly voice, if she has half an hour to chat, say you want to try out a new coffee shop. Drive her to a cash machine.........

I'd go round once more and ask for the money and tell her if you don't get it today then your going to make a claim via the small claims court.

I agree with @CoraPirbright here - a note through the door stating clearly that you didn't want to have to go down this route but as she has left you with no options, due to her actions of entering your property, removing your property in order to install her own, she has 7 days to pay restitution or you will lodge a small claims case against her for trespass, criminal damage, theft etc..and you'll be looking for a lot more than £100. It would be in her interest to settle this now and you will be happy to accept the previously agreed sum of £100 if she pays in the next 7 days.

Sounds like my neighbour. There’s nothing you can do about it that’s worth doing. She must be feeling very smug with herself. Is she telling everybody how clever she is.

When you’ve come up with some payback can you please let me know what it is. Personally I have just got on with my life.

Similar happened with our neighbour many years ago - we never got the money back. Karma got them though!

Send her a note informing her that you will be hiring a handyman to come put up a new trellis and will have a gardener sort out the plants due to her destruction of your property. Then tell her the invoices will be sent to her, unless she pays you the agreed amount before the works commence.

Except the OP cannot bring a claim for criminal damage, theft etc in the small claims court. They can bring a civil claim for compensation for nuisance. Criminal charges are brough by police/CPS.

This, get a quote and tell her part of her fence will have to be removed for "more room for to dig proper holes for your new work" and remove it.

Yes write her a letter informing her you're asking one last time and if the debt is not paid in a fortnight you'll be going to the small claims court. Don't just drop it.

you'd have to be able to prove it was her if you took it through small claims court and it costs more than 100 anyway. just put it down to experience and if she wants any favours in future you can happily decline. we have a neighbour who thinks its totally ok to hang over our fence and chop stuff down.

I'd just dismantle her fence, if that's good enough for her, it's good enough for you to do.
