To wonder how this man will be able to claim benefits/NHS treatment if he hasn't been living in the UK for years?

I thought there were rules about people needing to have lived in the UK for a certain amount of time (being habitually resident) and having paid into the system before people were entitled to claim? Feel sorry for this man but sounds like he needs psychiatric treatment rather than easy access to more food.

Well he can definitely come back as he’s a British citizen. And to be entitled to NHS treatment you just need to be a UK resident. So he absolutely can.

Longtalljosie - That's weird. My uncle (who is a British Citizen) was not allowed free treatment on the NHS when he became ill in the UK whilst on holiday (he lives abroad). He was told he'd have to pay for treatment as he wasn't habitually resident.

He may have kept a residence here or will move back into a family house. He probably is still registered with his local doctor. He will appear in the waiting room and get to see a GP no problem. I guess where he may get unstuck is at the hospital is they do ask about whether you’ve been resident in the UK for the last 12 months. I guess it’s up to him whether he lies at that point. If he says no then I’ve no idea what the process is at that point.

I assume if he’s 500lb he’ll have to book two seats on the aircraft and be healthy enough to fly 🤷‍♀️

If you move back from abroad you only need to prove an intent to settle, e.g rental agreement, council tax bill with your name on, proof you've moved back into a home you own etc.

For benefits you have to be in the UK for 3 months (if you are entitled to stay eg a citizen or a Visa). It's called habitual residence

It's the Daily Mail, and this man appears to feed on attention (and pizza). I'd take it with a supersize pinch of salt.

In a few months he'll be in the DM moaning that life here is not nearly as rosy as he thought.

Technically he should be living in the UK for 6 months for non urgent treatment. The Trust I work for is very hot on it now-no proof, no free treatment.

If you live elsewhere and are in UK on holiday, then you should not get free treatment on NHS (except certain things classed as emergency care)

The entitlement is based not on nationality, but on residence in UK. So if he sells up abroad and moves back permanently to UK he can expect the full range of NHS services.

He may be asked to prove (intended) permanency of move and that he is really residing here. And that will suffice (even though some
PCTs might try to add hurdlers in terms of time spent in the country, that is not actually the law)

You only need to be living in the country for 3 months to be a resident.

So your dad wasn’t a resident as he was on hols.
This chap will be entitle to it quite quickly.

The other thing to remember is that he has no choice. He doesn’t have a visa to stay in the US anymore
