To be panicking I'm going to end up homeless?

Just over a year ago my current landlord of almost 10 years gave eviction notice as he wanted to sell the property.

With bad credit rating it seemed impossible to find another place privately and nothing was available with the council.

My bf one 1 year offered to be guarantor and I was so desperate I took it.

The relationship has now broken down and he has just informed me that he has sent a letter to my landlord stating he is no longer willing to be a guarantor for me.

I have paid my rent on time every month without fail. Have been a good tenant with no issues and I keep it tidy and clean.

I'm so worried now that once the landlord receives this letter he will serve eviction notice.

Is this what is now likely to happen? I've settled well here with my children and I don't think I can go through all that stress again.

I appreciate you are worried but how can we secon gues your land lord? Go to him/her, ask what the solution is. Given the property is well kept, you pay on time and are no trouble, he's unlikely to chuck you out.

The fact you have paid on time for a year will help your case as you are seen as reliable in your own right. Have you sorted your credit problems? Are all your bill up to date now? Could you offer an extra month rent to be held by the agent as additional security?

My credit rating is still terrible. I had a dro.
I paid a security deposit when I moved in. I cannot afford to pay an additional month up front.

When my dad agreed to be a guarantor he had to sign all the paperwork with us so he wouldn't be able to just send a letter to back out? Have you moved Into this new house yet?

He signed paperwork for guarantor but I have no idea what the terms stated. That was over a year ago.

I'm pretty sure he can't just decide he's not doing it anymore if he's signed something. Can you call CAB or shelter to check? I think shelter have an online chat you can use.

Also, as an aside, I'm sure he hadn't actually sent a letter to your landlord. Sounds as though he's just trying to hurt you.

You have to check what the paperwork states re guarantor. Being a guarantor is a guarantee if you don’t pay your rent he will. The terms might stipulate that he is signing up to guarantee the payment for as long as you remain in the flat or that he can withdraw and you’ll have to either find another guarantor or move out. Nobody here sadly can advise you without you finding out from your letting agency.

I would try and ask around and find another guarantor in the meantime if you can.

Guarantor can't write such a letter and be excused of legal responsibility.
The only time a guarantor can 'pull out' is at the end of the contracted lease term.

As others here have stated ,you cannot just "back out" of an agreement like this as far as I am aware .When my son went to uni we had to sign that we would be his guarantors .This means that if you were to fall behind with any payments he would be responsible .Therefore I would think you were safe TBH. I think he is being rather unkind, and maybe trying to get back at you after the breakdown of your relationship .See if you can speak to the CAB for some clarification.If you are up to date with your payments ,and keep the house clean you should have nothing to worry about anyway!
