Crazy Shifts! 50hr week part time

Started a new job and from the beginning I stated part time over 4 days

The training was 5 days and intensive but I understood that was just for a few weeks.

Now the job has started and I'm being repeatedly put down for 5 days approx 40
Hours! Over the whole weekend too and consecutive pms which I don't get out til 1/2 even half 2 in the morning at times.

When I applied we weren't told what the exact shifts were and I've said my preference is am in the week and pm at weekends due to childcare but I also don't want to be working all weekend ever weekend as it's not fair on my family who have my children and I won't get to spend time with the kids.

I've raised the issue with 2 managers one who tried to guilt me into taking on another day that week and made out I was being unreasonable

The other said if I'm already rotad I need to find someone to pick it up so I can release the shift

I want to tell them look it's not workable for me with my children. I want to work am
In the week and maybe one weekend shift each week. Can I dictate this? I'm worried about getting in trouble.

I’ve never found my employers to give any consideration to my schedule when working an hourly job.

I would start looking for a job someplace that has a big lunch crowd. They are more likely to need servers for weekdays.

Do you have copies of everything you signed? The working without breaks is highly illegal. You must be starving and thirsty. It to mention exhausted!

@gabsalot you’re not entitled to a break every six hours.
It’s if you work over 6 hours, you are entitled to a break. So working 7 hours will get you the same amount of break entitlement as 10 hours will.
The break could be half way through too- is at the 4 hr Mark.

Not strictly true. You're entitled to a break if you work more than six hours. From the government website:

"Workers have the right to one uninterrupted 20 minute rest break during their working day, if they work more than 6 hours a day. This could be a tea or lunch break."

So someone working 6.5 hours is entitled to the same break as someone working 10.

Very few employers in hospitality give breaks to be honest. Even on (admittedly rare) 15+ hour shifts that I have done there has been no opportunity for a break (or in one case to even get a drink) so to get one after 11 is actually better than many other places. Unfortunately this type of place is busiest at weekends and evenings so that is when they need staff but if it is recently opened they may currently be needing more staff than they will in a few weeks so the number of hours offered may well reduce naturally anyway.

We don't get a break unless we're scheduled for over 10 hours then we get an hour break

Unfortunately I think this sort of thing is pretty common in the hospitality industry particularly within some well known chains.

My DD worked at McDonalds for a while, they kept giving her shifts when she was supposed to be at school, which they knew from the start, she filled in an online thing to tell them her availability and they 'declined the request' she emailed her boss and said, it wasn't a 'request' I was advising you when I was free. Nothing changed, they see you as ratio number who should be committed to them at their beck and call, rather than a human being with a life and commitments.

This works for some people, but anyone wanting proper part time or anyone with a family it is so hard and will probably never be a good fit.

I think your best bet is to look elsewhere if possible for a non chain restaurant, a smaller organisation who will actually listen.

Have a look at the working time directive/equivalent law as i’m sure you have to sign it to work more than 13 hour shifts (you need a minimum 11 hours between shifts).

I understand you need the money(who doesnt)!.But it sounds as though you are being treated very shabbily indeed .That said if you are working for the hospitality industry then hours will be moved around to accomodate the business Im afraid.If you can ,start looking for another job asap as you have more chance of getting work if already in employment.
