Car/junction/who is in the wrong?

I've no idea actually so help me out. I've a feeling it's one of those 50/50 situations but I did feel miffed that the other driver couldn't just wait 5 seconds until I'd passed (all will become clear!).

So I'm driving along, car parked on the road on my side so I look ahead and road and junction ahead is clear, so I start to pull out to overtake. Before I'm able to pull back into the left, a bus appears at the junction ahead, sees me and starts turning left (to meet me head on) anyway. I pull in as quickly as I can but not before the big, impatient, grumpy bastard has given me a filthy look!

I know everyone will say the obstruction was on my side and I was on the wrong side of the road, but the road and junction was clear when I started pulling out and there was physically no way to get past it without moving to the other side of the road.

Waiting to be abused and told I'm an asshole :)

You were on the main road, you had right of way. He was turning onto the main road and should have waited until it was clear to do so.

Red car shouldn’t be parked opposite a junction either really.

Well you were on the major road. The driver on the minor road, turning onto the major road should not pull out until it is safe to do so.

The bus must have been going at some speed though to have not been visible when you first started to overtake the parked car. I still think it was your right of way if there was nothing coming towards you on the main road.

Bus driver was in the wrong if you were already in the process of overtaking the obstruction. He is joining your road, not vice versa.

A vehicle already on the main road travelling towards you on the right side of the road would have had priority over you. The bus was turning onto a main road from a side road - you have priority over them.

In my view, the bus driver is in the wrong, as you had already pulled out, and were already level with the parked car etc when he decided to turn.

Just because he’s at a junction and normally can turn left, doesn’t mean he can and has the right to, irrespective of what’s already there. You have a right to use the other side of the road if you need to pass something. So he had to wait.

Him pulling out when you’re already passing is pure aggression or silly posturing - he should observe what’s there, wait for you to pass, then pull out.

(It goes without saying that if he was already edging out, when you took a look and tried to zoom past, then of course that’s different - but that’s not what you described, so as far as I’m concerned YANBU and he is dry much U)

And agreed with previous posters, it was your right of way on a major road.

He has to take into account that you were passing an obstruction to make progress.

He has to wait at the minor road junction before it becomes clear

The owner of the parked car is an idiot.
I was under the impression that if you have already begun a manoeuvre to safely pass an obstacle on your side of the road any traffic arriving after you've begun has to let you finish going past the obstacle.
If the bus wasn't already waiting by the junction then he should have waited.

If the bus started to turn after you'd pulled out to overtake, then he's the arsehole, not you. There's no grey area here. OP YANBU at all.

You had right of way as you were already on that road. The bus driver joining the road should have waited until it was clear. A lot of bus drivers are entitled gits though.

There's insurance case law on this, I'm sure of it. Can't remember but I think liability would be 70/30 in your favour? Any insurance bods around who can confirm? It's been so long ago I've forgotten it!

Bus driver. The bus will have CCTV, email the bus company with all the details and complain. They were not driving safely. I'd be annoyed at the person who parked their car so near a junction.

Thanks all! I thought as I was overtaking I'd automatically be in the wrong!

The bus wasn't going crazy fast, I know I sound paranoid but I think he saw me and was pissed off I was on 'his' side of the road so pulled out to make a point!

You were on the main road and even though obstruction was on your side you had already pulled out so the bus has to wait until road is clear again.

Bus driver was 100% in the wrong. You couldn't have pulled in quick enough and it was your right of way.
