Moved into a lovely little one bedroom house on my own in January. It's just big enough for me and my dog (who I have permission for). It's been a rough few years with some financial issues following a break up (ex left me with debt which I worked hard to clear) and some serious health issues. I was just feeling settled at last and just about got this place feeling like home.

Yesterday morning I got section 21 notice to leave.
I have paid rent on time every month. There have been no issues. Landlord just has told the agents that I'm not right for his house. That I'm too big a risk with my health issues (I stupidly told his partner when I bumped into her at a hospital appointment). I work full time and am coping well with my health issues at the moment. My credit rating is ok and I have paid on time every month.
He is also not happy with the fact that I am friends with my neighbour who he has had run ins with in the past. He kept the garage that comes with this house and is here lots pottering about in the garage.
He also is complaining that I haven't cut the grass for two weeks since he announced he didn't want to do it as he had verbally agreed to do when I took on house. I have no outdoor storage space for a lawnmower or strimer and he won't consent to me having a outdoor storage box. The garden is tiny.

The estate agents have been really apologetic and have told me they are not going to relist the house for let for him as they take a dim view on landlords treating tenants like this.

Aibu to be really confused, sad and pissed off at the way I am being treated? And to hope soon tenants will truly have better rights.

No you're not BU to feel like that but you will be much better off somewhere else rather than having constant stress renting from this man so try and look at it as a blessing in disguise -good luck with it all x

Of course YANBU at all, but pp has a point. He would likely have been the landlord from hell and would have made you miserable, so if you are able to find somewhere else it may be better in the king run.
I know it's easier said than done though, especially after what I've already been through.

If you have any proof at all that it is due to your health then he is in breach of the equality Act. This is a common issue for people with children with special needs. Talk to shelter

Sadly no I can't prove it. Even if I did I'm not sure it would help? He doesn't need a reason to give me a section 21 notice does he?

Definitely contact Shelter. They will be able to advise on your specific situation. Meantime - sit tight, don't speculate or jump to conclusions. Start doing research into what other accommodation might be available, but don't do anything rash until you have got advice from Shelter - they are the experts in housing after all.

Do you have an AST (assured shorthold tenancy)? Is it fixed term and is there a break clause? You can't issue a section 21 notice unless you have an AST and not before the end of the fixed term, unless there is a break clause.

Haven't they recently changed the law about this sort of shit? Or has it not come into force yet.

I had a 6 month tenancy and he has given notice for the end of tenancy. It would have gone onto a rolling contract otherwise

Ask the agent if they have any properties or know about any. They are obviously on tour side and ai am sure they wouldn't mind helping a bit.

Agree with pp. It sucks, but you are better off elsewhere. I am assuming it was AST for 6 months? Dates would fit.

Something is odd. A landlord that particular wouldn't normally agree to renting to dog owners. I expect it's the news that s21 are soon to be disguarded making it much more difficult to evict tenants and he is worried your health might mean you going on sick leave and not be able to pay.

Although I totally agree with you that he shouldn't be able to evict you when you've done nothing wrong. I can't help wonder whether this new law will backfire with landlords handing out s21 to tenants they have some concerns about before the law come into action.

I think it is the announcement about them getting rid of section 21 notices.

I'm really confused about section 21, I don't know what a landlord would do now, without section 21, if they were going to sell.

I can imagine landlords issuing notice to avoid a change in law (if I've understood the law correctly).

I suspect there will be a lot of Landlords getting out of BTLs, issuing
21 notices to sell up as the new laws definitely are very pro tenant and do not give Landlord adequate protection against bad tenants.

I think the new laws come in in June so he has obviously made a decision to take advantage of the old laws.

Hopefully you will find somewhere just as nice with a nicer LL>

Not selling. He marched into estate agents and demanded they kick me out and then re rent the property ASAP.

The estate agents said no to re letting property as I'd done nothing wrong.

He's out the front of my house now in his garage (man cave)

I would think he would be renting to someone who would have to sign a new contract every 6 months.

He might not get as good a tenant as you as very few would put up with the ll having access to the garage.

Seems a strange little house if there is only 1 bedroom but with a garage.

If attached to the house he would get more if he made it another bedroom or just another living room

@Rosa I think the plan / consulting is that s8 eviction process will be updated to include selling or landlord moving back into the property

Is the deposit protected and did you receive all the prescribed information? If not, the S21 is invalid. I'd keep quiet about it if it is invalid as he cannot remove you until he has returned your deposit in that case.

As others have said, it is great that you have the letting agents onside. They can tell LLs on their books what a good tenant you are, so it could work well for you.

Once you are settled somewhere else, I would turn nasty but you are probably a lot nicer than me. I wonder if he is declaring all his income to HMRC. I hope the gas safety checks are up to date as the H&S people have a lot of power. People who behave like your present LL often think that rules are for other people Wink
