Wibu to say I can't pay it yet?

I moved to a new place on 10th April. Paid a month's rent upfront but didn't have enough for a deposit too. LL's were ok with this and said I could gradually pay a bit extra to pay this off over time.

I get paid weekly at the moment - I actually have 2 part time jobs, one paid weekly and one monthly. The monthly one I haven't started getting paid yet because I've only just started it, I get paid at the beginning rather than the end of the month.

LL's have messaged today and said my rent is due. I've responded and said that I thought I only had to pay a month from my move in date as I have only been here less than 3 weeks. They said that if I decided to leave then this would be my last week since I haven't paid my deposit yet. But I have no intention of leaving?! I don't have a minimum term contract or anything on my agreement stating when rent is to be paid but they know that at the moment I'm only weekly paid, I just don't have enough yet.

Wibu to say I can't pay until 10th? I'm worried they will kick me out if I don't pay but I literally don't have it, my overdraft is maxed out, I can't borrow any more money and I have no where else to go. I'm so worried Sad

If you don’t pAy they will probably give you notice and I don’t blame them.

You have barley been there and your already saying you can’t pay your rent

Surely as part of your rental agreement it states what date each month the rent falls due? I've never known one that didn't (at least not from a decent landlord/agent).

What date does your contract say? It should specify the date that the rent is due on.

It doesn't specify the date or I would have been expecting them to ask for it now. They never mentioned a date when we spoke in person.

I CAN pay my rent. Just not yet, as I haven't accrued a month's worth of payments. Since I only get paid small amounts every week rather than one big payment per month, I've only been paid 3 times since moving in and I don't get enough in that time to cover the whole month. They knew this when I moved in.

Next month things will be fine because I'll have my big monthly payment I can use for rent and I'll have the smaller weekly payments for food, bills etc. I told them I would set up a standing order on a set date when I start getting my monthly pay but I just couldn't do it the first month.

They are private LL's, not through an agency. It's a shared house so cheap accommodation as that's all I can afford.

I've literally done 2 days training at the monthly paid job, there's barely anything to give in advance yet.

You can’t pay your rent as they clearly want paying at the end of each month and you don’t have the money.

How were you paying your rent before OP?
Have you paid a full month's rent from 10 April?

I think you are pushing your luck (no deposit AND late with rent) but as it is a shared house and you are dealing with the landlords direct it might work out if you specifically say to them you've misunderstood and thought the 10th was the date rent due.
I'm amazed that you gave them money without a contract, and that they gave you keys without a contract too.

Can you pay anything at all in the due date?

If the LL has bills coming out in the days immediately following your rent day, I can see why they’d be annoyed m.

Please ignore Order654 who can’t read and doesn’t know what they’re talking about.

They are essentially asking you to pay them a week early. That is unfair & wrong.

You moved in (for example) on Xth March paying one month’s rent (which did not include anything towards the deposit), right?

Your next payment is then due on Xth April - another one month’s rent.

Paying for the deposit incrementally is entirely separate.

Presumably they are not live-in landlords, so you have an AST. Doesn’t matter if it’s not written down anywhere....the law assumes one on your behalf.

Contact Shelter and get some advice. They don’t sound like good landlord’s to me.

So you paid them a months money 3 weeks ago and they want the next months money already?

If you've paid a months money, you are paid up until the 9th May, surely?

This doesn’t sound very legal at all. No contract. As for the deposit you could have done the zero deposit scheme, where you pay the equivalent of one weeks rent to an insurance policy, which isn’t returned.

I don’t understand why they want the rent now. If you paid a full months rent in advance you’ve paid until 9th May, which is the due date.

Do you have receipts for the payments? Don’t move out because they’re telling you to.

She’s been there less than three weeks and paid a month up front when she moved in. So they are asking for their rent a month early.

I think you need to clarify some things with the LL.

Remind them that you paid a month's rent on 10th, and ask them to clarify the dates that rent is due. If it is the end of the month, then to be honest you shouldn't have had to pay a full month on 10th - unless they were taking some towards the deposit?

I can understand that with no deposit the LL will not want to have you in the house if the rent is not covered. Perhaps you can negotiate something to pay weekly until your monthly pay comes through? If your overdraft is maxed out and you won't get paid until net month, how were you planning to pay the rent after 9th May?

It sounds a bit flakey on both sides to me. I would take your contract/agreement to the CAB or Shelter and make sure that you have adequate protection. But you DO need to be able to pay the rent and you Do need to find the deposit asap too.

They need to put the deposit into a government scheme, too, so ask them which scheme they will be using and make a firm agreement about when you will be paying that deposit.

Well as I landlord I would never of let you even move in to be honest. So you got very lucky

I can pay my rent. Just not yet 😂 Try that one in Sainsbury’s with your shopping....

Of course your being a cheeky so and so but as your dealing with the landlord direct, speak to them and see what they say

OP is not being cheeky at all. The landlord let her move in without a deposit and did not specify that the next rent payment would be due in 3 weeks not 4.

Landlords need to act in a professional manner. It's a business they're running.

Back up a bit. House share? Or are you a lodger? Do your landlords also live in the house?

You moved in on the 10th, paid 1 month's rent and no deposit.

So your rent payment date is 10th of the month and you still owe them all of the deposit?

You have no written contract? What is the agreement you mention?

We'll need the answer about the house share / lodger situation before we can give dvice on that!

You don’t have to pay a deposit, so if they’ve let you move in without, that’s their lookout and there’s nothing for you to worry about with regards to that. It’s not a mandatory thing and lots of landlords don’t take them.

If you paid up three weeks ago (early April), you would assume that the next rent payment is due that date in a months time (early May). Your contract should state the date that rent is due, and you and the landlord should both have signed and agreed this document.

If they have issued you a contract without this information on, they are not meeting the requirements of an AST contract. They need to supply you information detailing the contract start date, tenancy end date, rent due date, contact details for landlord (or their representative) etc. This may vary slightly if you are a lodger, but sounds like you’re living in a shared house with an absent landlord (?) so would fall under HMO requirements and therefore the same rules apply.

As PP have mentioned, Shelter are a good bet, the Cit Advice Bureau or the National Landlord Association should both be able to offer advice too.

I don't understand what being are misunderstanding :S Why are people raging on OP when the LL are in the wrong? you cant just charge someone rent before its due...if you pay a months rent then you've paid for a month.. it isn't due for 4 weeks!

But she gets her rent paid monthly!!! The rent should be paid monthly, what are you not getting?? its really not that hard fgs.

Normally say you move in on the 1st this is what would happen:

You move in on 1st April and pay a months rent THEN you pay the next month on the 1st May not the 24th April because otherwise people who get paid monthly would be fucked...

I'm also wondering if the landlords consider the month to have started from the 1st, regardless of when OP moved in. Without a contract, it's hard to know
