AIBU TO THINK THIS IS UNFAIR, it's private land??

It doesn't really force you to do anything with it.

Just stop the engine, pay for your food. All good.

Greater Manchester Police Traffic replied: "If your engine is off and your handbrake applied and you're parked yes. If your engine is on no."

Not a problem then, just turn off the engine and apply your handbrake.

No-one forces you to only use your phone to pay. What would you do if the battery went dead, or your phone was lost or stolen?

Why is this being discussed now, the law has been in force for ages?

YABU. It is a public place as the public have access to it, and as such the Road Traffic Act applies.

Ludicrous. Apple Pay is the same as contactless on a card. You have to rummage around for a card in the same way you do a phone and it’s the exact same motion tapping it against the card machine. Nobody turns off their engine when they’re going through a drive thru.

I’d actually argue it’s more dangerous to rummage around for cash and accept change than it is tapping your phone against a card machine.

Wow. Two publications for whom accuracy, proportion and balance are watchwords.

Are there any cases of anyone being prosecuted or police actively enforcing this or is it one of those cases where the law hasn't kept up with technology and someone could be prosecuted but almost certainly won't be.

If you feel thr miniscule risk of getting your collar felt for buying sgit food in a drive thru with Android or Apple pay is too great, then do as others advise, engime off/hand brake on and move on with your life.

How many people have you seen run over in a drive through? People don't walk there, its not a pedestrianised area. Hmm

No, that's why most modern cars have a stop start.

That's as maybe, but the legal position is that it is a public area and the Road Traffic Act applies. So to take the example of a drunk careering around a supermarket carpark at speeding abnd without a licence and insurance is subject to the law.

A car park is completely different to a drive through. In a drive through you are corralled into an enclosed (kerbs etc) route that you can only drive single file in.

With all the cuts and pressure the police are under I'd think and expect that they had better things to concern themselves with.

Alright, a drunk uninsured driver ploughs into the back of you whem you're in the drive thru queue if you really want to split hairs.

Anyway doesn't matter what you or i think, that's what the 1988 RTA says. Both are public places.

With all the cuts and pressure the police are under I'd think and expect that they had better things to concern themselves with.

They have and do. There's been penalties for driving when using a mobile and google and apple pay have been a thing for at least five. Have you heard of anyone getting a fine or points for using them to pay for a McSlurry? Id guess it is a grand total of a big fat zero.

This falls under the category of a technicality.
