Ds’s college want to end his placement after an incident. We went to a meeting with the local authority. They told the college that at this time these not enough evidence to them for the college to say they can’t meet his needs. They have offered the college a form to complete and told them them it has to be sen tribunal standard. Now to me and my ds this indicates they agree with them and are planning on taking it to tribunal. Ds was asked what he wanted and he said to stay where he was but he know that was unlikely to happen. The la rep said “you don’t know that we get to decide” aibu to think that’s unfair to play with his feelings? And would just be easier for all involved if they disagreed now rather than delaying.

I don't really understand what has happened. As he been permanently excluded? It would be unusual for s tribunal case to be triggered unless you were seeking the tribunal.

No he hasn’t he’s got an ehcp. He’s not been excluded at all.

So they cannot just end his placement. If they want to discuss the fact they don't feel they can meet need, they need to call an emergency annual review and raise this as an issue. The LA can still be minded to direct the college to keep him and explore the provision in place to see what needs to change in order to meet his needs. If he still wants to attend and the paperwork shows they have not used the provided resources and advice to meet his needs, then they need to do what the ehcp states or request additional resources. If he is not in the correct placement, then alternatives should be explored as part of a managed move.

Thank you for you response the meeting we had with them was a review. The la said to ds they may direct if they feel they have a case to it depends on what the college write on the paperwork.
