Neighbour planted tree on my front garden.

Where I live our gardens have bushes that I mostly own which divide our gardens, apart from some which creep onto the end of his garden.
He has planted a tree which is over the boundary onto my side.
I feel almost a bit silly to ask him why he has done it as its just on our property. But slightly annoyed that he would do that.
Its something I would never do and would always makes sure anything I would plant would be well within my boundary.
Its also very close to his house if it became a problem in the future and damaged his house would I be liable as its on my land?
I dont know whether to say anything?

“Lovely tree, but I hope you don’t mind if I suggest moving it so that it is across the boundary in to your land. I wouldn’t feel comfortable with a tree on my land having the potential to damage your house. We can move it now before it gets established.”

Any further push back:

“The fact is that I would prefer not to have your tree on my land. You might not have realised where the boundary is. It runs from here to here “
Then:
“In the end, This is my land. So either we move your tree now before it settles in or I will simply uproot it and chuck it to your side of the boundary”

Yes, move it now before it takes root. You don't want to set a precedent for this kind of thing.plus, If it damages his house he may realise its his own tree but future owners would say it was your tree = your fault.

Just talk to the neighbour, it sounds like the boundary is not totally clear to him and he's made a mistake.

I wouldn't get annoyed unless it turns out he's into some sort of passive aggressive tree planting.

I would hope so Chouetted, I dont know how he wouldnt know though.
Its obvious.
Even my other neighbours remarked on it thinking I had put it up.
