To think an agent can’t refuse to put my offer forward?

Best and final offers were asked for and mine was declined.

I then was advised by another estate agents that they are legally bound to put forward any new offers to the vendor until the contracts have been exchanged.

I’ve asked to put a new offer in and they refused ad they said it’s unethical. Surely they can’t do that?

Usually an estate agent has to pass on all offers however they don't if they have been instructed by the vendor that they do not want anymore after they have accepted.

Perhaps this is what has happened to you? The vendor may not want to 'go back on their word' after accepting another offer or they just don't want to sell to you as you've tried to increase after a best and final (even though you have a reason--they don't know that). They might feel you could be a hassle to sell to and might want to drop your offer later down the line.

As a buyer, I've done the reverse. Refused to increase an offer by 5k (considering our purchase price it was insignificant) as I knew the sellers would be trouble.

The agent selling the house we were buying called to tell us that an offer had been received from someone who had seen it before us and they were obliged to put the offer forward even though our offer and its acceptance had been conditional on no further viewings. Luckily, it was declined!

Eh, you've already tried that, the agent refused to put the new offer forward. Remember? That's the whole point of your thread.....that you actually can't put in your higher offer...

But what do you think "best and final" means then?

On face value, I'd assume it meant exactly that... but I've met some estate agents who seemed to use 'best and final' as a
starting point and then tried to push us higher (when the whole idea was that we couldn't go higher!). I really lost faith and stopped using said agents when that happened...

I can’t believe there are still people on this thread who think the estate agents are taking some moral stance off their own bat. Wake up! The only reason they would not pass on further offers is if they’ve been instructed not to do so.

Oh by the way I wouldn’t offer a further £20k ... my original offer was very close to what they were already asking so I would be paying way more than what it’s actually worth.

You’re really not. Good luck with all your properties. I firmly believe that money or possessions that are acquired in such an underhand way bring nothing but misery.

Feeling sorry for the person/people whose offer was accepted and who are probably on pins hoping not to be gazumped.

I am sure the estate agent is aware of the law on this and not breaking it just to annoy you. There must be a rule either because 1) best and final was asked for or 2) seller has stated do not tell me about any more offers.

Why would an estate agent risk breaking the rules in this instance? I am sure they know the law on it very well.

And if I was a seller I would not sell to someone who matched/slightly above original buyers offer in this circumstance because you appear unethical and cold and I would not trust you to really want my property so I would worry it would fall through. Also wouldn't want to let current buyer who played by the rules down.

Move on, put your energy into something else.

You were asked for your best & final offer.

It was declined, and now you are trying to make an increased offer.

It’s unethical because you’re trying to gazump the other offers - those that went in with their best & final offers.

This is how it works, when it goes to best & final offers, they’re looking to weed out the buyers that are going to make low offers and gradually increase them til their offer is accepted.

If it’s still not sold in a weeks time, perhaps you can go back and try again, but it sounds like you misinterpreted the rules.

They probably just think you were trying to get yourself a good deal with a lower offer
