I am watching police interceptors and some people have been charged with driving without a licence. It then says they received 6 penalty points.

Where do they put the penalty points if the person doesn't have a licence to put them on?Confused

Sorry, I know it's probably a daft question but I'm genuinely perplexed Confused

It's like when they send someone to prison for a driving offence and also ban them for a year, but they're in prison for that year. It doesn't make sense.

I presume the points go on the licence when they do get one.

And as for the ban on driving, doesn't that start from the moment of their release from prison? I don't know about that, but it bloody well ought to!

Hollow - the time they would serve in prison is now added to the ban time so in effect the ban starts from when they're released or there abouts.

I think the points just get put on if they ever get a license, so they probably just won't ever get a license? 🤷‍♀️

Hollowtalk im sure there was a petition online to get it changed so the ban came into effect once the sentence was served. It's such a stupid rule. (Unless its changed recently)

They will be on the DVLA system so when that person applies for a license it will go straight on their licence and one more point in the first 2 years would have a ban.

It might not be just "driving without a licence" but rather "driving not in accordance with a licence" so eg they drive a bus but they only have a licence for a car then they'd be charged and points added to their car licence

Far as I know nowadays the ban usually either starts once the custodial part of the sentence ends, or is significantly longer than the sentence. But even if they were both a year and starting at the same time, they'd be out of prison after 6 months and so still be banned. A ban also often comes with the extended retest requirement.

As PPs have said, I believe if you get points when you don't have a licence, it would be recorded at the DVLA so if you do apply, you start out with points

A ghost licence is created at DVLA and points added.
They can also be put on the provisional licence.
