Potential CF house buying/moving

Currently in the midst of trying to move house. House went on the market start of the year. We had a fair amount of interest and accepted an offer relatively quickly having found a house we were really happy with and had an offer accepted to buy. We accepted an offer lower than asking price on ours because we wanted to be in a position where we had sold for putting forward an offer to buy next house. Fine our decision and still left us with enough to buy next house. So far so good and our buyer got a bit of a bargain in the process. Buyer then comes around a fair amount measuring up etc and then makes a strange claim about her searches throwing up something strange. So I get out the searches we have paid for when we bought current house to show hers are incorrect. She then asks me for a copy of the homebuyer report that we paid for when we bought the house. I wasn’t happy about it but then I thought needed to keep her sweet. So again gets a bargain as she’s not had to pay out £300 for mid level survey. All solicitors moving towards a completion date asap and as far as I was aware we were good to go at the end of the month.

Then we get an email to say our buyer that they can’t move for another 13 weeks due to them being in rented accommodation and they can’t afford to pay for both the rent and the mortgage. Shit situation for them but not my fault. My sellers are then really cross and say they won’t wait that long and are threatening to pull out. I ask buyers if they can move any quicker and they said no. We don’t want to loose our next house it took ages to find one that meets all our requirements and need to move ASAP.

Buyer comes back to me to say would we be prepared to pay them £800 to cover a months rent so they wouldn’t be as out of pocket!! I’m really pissed off. I feel like they have have got me over a barrel because If I say no the whole thing will collapse. It’s a case of who had the biggest nerve. If I stand firm and threaten it will collapse they might just suck up the rent and mortgage but then my sellers might pull out putting us back to square one and us loosing all the money we have already spent on searches etc.

To compound the issue we are due to start IVF treatment soon and I just don’t need this stress. We thought we would be moved before treatment starts.

AIBU in thinking buyers are cheeky fucker for asking us to pay their rent when we have already be more than accommodating?

AIBU in backing down and agreeing to it to keep our dream house?

AIBU to be pissed off about the whole situation?

Do I need to just stop moaning?!

Do NOT take anything that you said would be staying, these things have gone to court plenty of times and you really don’t want to hand over compensation to this CF as well.

for £800 i would go ahead if you can afford it - with conditions such as so long as exchange and completion are by X date, and they receive the money on completion

CF’s like this will no doubt try pulling a fast one like dropping offer price last minute. I’d get solicitor to draw up agreement that any attempt to drop price results in the difference being doubled for them.

Landlords have to give 2 months notice, tenants one if the original time on the ast has passed. They’re taking the piss. Tell them to jog on and put the house back on the market.

I actually think after the £800 it will be something else. There’s also nothing to say that you pay them £800 and the sale falls through or they pull out and you’re then £800 out of pocket. Getting that back, even if it’s tied up legally could be a nightmare

Or you could offer to pay the the £800 and you put £800 on the asking price and they mortgage this

If you're in UK... A standard residential tenancy doesn't usually have a 13 week notice period....

For standard ast.. The tenants give one month notice and the landlord must give 2 months afte rthe initial 6 month/12 month period... Unless they've started househunting having already signed themselves into a too long lease

That was my experience. No one is going to lose a house for £800. Either they have no intention of buying unless they get a lot off, or they have every intention of buying but want to chance their arm.

even I did put it back on the market I won’t sell in enough time to still keep our dream house.

Putting it back on rightmove and taking the sold sticker off is about sending a clear signal you are willing to walk away. If they are 2 weeks from completion, the solicitor has done most of the work and they are committed- or they were never invested and haven't cracked on.

You won't drive them away be saying no, you will just find out the real situation.

Go back on the market tomorrow.
Offer previous searches etc to any potential new buyers.
Your buyers will stop being CF and suddenly get a push on I guarantee it if you stay firm and call their bluff

I'm reading this in a completely different way as am trying to buy a property myself. You accepted their lower than asking offer because it suited you for your onward purchase. I never understand the hostility towards buyers about them 'getting a bargain', almost like it's done them a favour to accept their low offer. It might not be a bargain for them, might be the top of their budget. Also made sense to see your survey as you already had one but do understand it's a big saving for them by not having their own survey done.

I think the people who you are buying from are the CF. If your buyers have 13 weeks to cover it's a ton of money, they are being forced in to moving before they can afford to because your vendor is calling the shots and threatening to pull out/refusing to wait that long. They originally said no to you, but perhaps have worked out some figures and a month contribution would allow them to move earlier hence proposing that?
If your vendors don't need to move as downsizing then why can't they wait? I'd be more bothered about their behaviour TBH

Don’t do it, call their bluff.

If the sellers start the process again it could take longer than 13 weeks.

Let your buyers pull out. You’ll find another house to buy.

You need to let go of them getting it at a reduced price - you agreed to it and they wont see it as them getting a bargain.

Offer £400, shows willing and not that much in the grand scheme of moving, if rejected pay the lot, you'd only have to shell out more than that if you had to do new searches and solicitors fees etc.

Don't take anything, just badly paint the walls, ceilings and woodwork really minging colours Grin

The people who you are buying from are the ones you need to be wary of not your buyers. I was ready to exchange and complete on a property where the vendors were downsizing. All legal work done estate agent calls them with an update that exchange is next week with completion the week after. Vendors then withdrew the property from sale and decided to stay put. They are in control, if you want to get it over the line you may need to help your buyers out.

Consider that they will be getting their rent deposit back at the end of this too.
Why one month's rent but three months hold up? Doesn't smell right at all.
Call their bluff. At this point they should push their solicitor and the chain to complete on a date that ties in with the end of their tenancy, ask their ll to be flexible or end tenancy and move in with parents/friends until it is completed.

I'd go back and say you will add it to the asking price.
And that you are putting the house back on the market.

So your sellers are in no rush to move but won't wait at all?!

I think a lot of what you've written sounds pretty normal. (As others have said, you agreed the price and it might not be a bargain to her etc.) However, the rent bit isn't adding up to me. Why 13 weeks? Surely she only needs to give 1 month's notice? I'd be questioning this, I think.

I am smelling some bullshit. The 13 weeks doesn’t make any sense. I think there will then be something else and some gazundering. I would say no. Moving house is expensive for everyone, they should have saved more / budgeted better / not signed such a long lease (delete as applicable)

It sounds like their landlord is refusing to let them out of a lease early which is unusual - unless they have just moved in. I'd be asking for proof that the landlord has said no.

I think your buyers are on fixed term contract hence 13 weeks. If so, I can really believe that some people might find difficult to pay rent and mortgage together, even for 1 month.
Are you sure that everything else are in order and they won’t ask for another searches or something else? I would ask to see the contract and agree on the condition that exchange straight away with completion date which suits you.
