School Facebook again!!

I had a thread about this back along. School have continued to post photos of my dc without my consent. I have made 3 complaints since January.
Each time they have removed the photos but done it again.

This week they did it so I write to them stating this was an ICO breach and I requested a written response from chair of governors and the head. I stated I was considering legal action.

They removed some but not all the photos.

Secondly they sent dd1 class teacher out into the playground to grovel to me. I really like dd1 teacher he is very good with her. I told him I didn't accept he is responsible for for Facebook content and again required a written response as above. He stated that was being prepared but I haven't had it.

There are still photos present on the Facebook page.

I'm at a loss where to go with this. Legal action would be demanding compensation. I'm not taking money from my kids school.

So the ico protocol appears to be that I write to the organisation (the school) and give them 14 days to respond then you send the original letter plus the response off the the actual ICO if that makes sense.

...it's a photo lol, not think you're maybe over-reacting a bit? Ok I get that there are lots of perverts out there but...they already know there are children at that school right? It's not like your name and address are under the photo right?

I get that it's maybe the principle of it...but really it just comes across as a bit craycray when the words 'legal action' are even uttered. Maybe take a chill pill.

Tea. Some children are adopted and have been specifically told Not to have their children's faces on social media.

Some children are under protection orders.

Some children need privacy.

This is not 'just a photo' in many situations.

Even if non of those apply to OP she still has every right to refuse her child's photo being on a public social media page.

Look up your school complaints policy and follow it to the letter. Copying in a letter to the Chair of Governors is not the same as making a formal complaint for investigation.

Report the photos to Facebook.

You have no idea why the OP needs to have her children removed from the FB page.

Not that it matters. I hope there is no specific safeguarding issue with her children. The school have a responsibility where parents refuse permission, otherwise what’s the point in asking? The OP is quite right to take this all the way even if it is just down to her own preference, as the school need to learn to do things properly.

OP make a fuss. This is atrocious. Once can be a mistake.
Continuing to post photos is negligence.

It's not rocket science for the school. They have one or 2 people who check and approve photos from a protection point of view. They have a list of names of who isn't approved and they make sure no photos containing them are uploaded. The fact this keeps happening means their processes are either rubbish or are just being ignored.

ICO will do nothing, my daughters estranged father who she’s never met was given all sorts of information about our family, including financial by the bursary. They did nothing, didn’t even insist on an apology

This is just outrageous.

I don't get it at all.

The school don't need to put any children in Facebook.

The school obviously doesn't have a clue and or doesn't care about children or safeguarding.AngryAngryAngryAngry

I would write to the chair of governors & head teacher saying something like:

I am writing to you as a formal complaint regarding the poor safeguarding and information protection practices of the school with respect to posting photos of children online whose parents have not given consent.

On X date this occurred …
I spoke to Y and photo was removed. I reiterated no consent

however on Z date his occurred
I spoke to A and 3 photos were removed but still 2 were left.

I would like an urgent review of policies and working procedures regarding how permissions are stored and how photos are authorised to be posted online. I would like these to be tightened as necessary and all staff reminded of the correct procedure.

Until this is done I would like a stop to be placed on any photo containing children being posted online by the school.

I would appreciate an acknowledgement of this letter by the end of term, including a block on publishing of photos, and then a more formal response of the outcome of the procedure review within 3 weeks of the new term starting.

As you know I am usually fully supportive of the school, and it pains me to have to write to you so formally on this. I am hoping we can get this issue sorted without me having to raise it outside the school structure.

My sons face can never appear on Facebook he is at high risk. I would feel the same. Go to the school office ask who has the password and sit next to them refusing to move until it's done.
