That it is the bus’ fault? - diagram!

If a bus hits your stationary car then it is the fault of the bus... not my fault for being “ near the centre of the road”?

Bus tried to push past turning left and clipped my car. I was sitting in a stationary queue (although the light was green). The bus probably wasn’t aware of a traffic island forcing me towards the left but just thought I was in his way?

Anyway I have complained to the bus company who say that “ as we were both moving” (I wasn’t!) they can’t be at fault...

There is minimal damage to the car so I don’t want to go down the insurance route but an apology for their twatty driver who just swore at me and drove off would be nice!

It rear-ended you. Surely it's the fault of the bus. Maybe you need to start talking about whiplash (I'm fully aware it's fraud if you don't have it) and how lucky for the bus company that you are such an honest person that you wouldn't try to claim it...

Good diagram, but your queue of traffic should have been further forward as you can sit in yellow hash boxes when turning right, the bus driver was probably cross your line of cars were in his way and tried to shove past you. I don't think you will get anywhere with them tbf.

wtf as the exit route is not clear, her line of traffic could not wait in the box. You can only do that if your exit is clear but you are prevented from turning right by oncoming traffic

Yes it's the buses fault.

Don't rule out going down insurance. My old car was hit when parked and because off it's age it was economic right off, even though it was only cosmetically damaged, but they let me keep the car and still paid me nearly £1000. My insurance premium has only gone up by about £10 per year, so was worth reporting it.

Yes, of course it isn't your fault. Even if you were stopped in a yellow hatched area - another motorist isn't allowed to hit your car!

I would ask them for a copy of the bus cctv as well as photos. That will show clearly that you were stationary, while the bus was not.

To be honest yes they should have stopped. If the damage is minor why make a fuss? Nobody has intentionally gone out of their way to cause lose to you. Your road positioning was inconsiderate but that doesn't change the liability. Overall I would write it off to experience. I await flaming!

The bus rear ended you. Whether you were moving or not is irrelevant. If someone hits you from behind it’s their fault. I’d pursue this through the insurance on principle.

A bus once hit me as a pedestrian and the driver got out and yelled at me that it was my fault for "standing on the wrong bit of the pavement", so this doesn't surprise me in the least!

(Luckily it "just" clipped my shoulder and knocked me off my feet, no damage done, but the driver's reaction was as bonkers as this scenario.)

I got side scraped by a bus at a roundabout once (I was stationary) the bus company tried a 50/50 claim which I refused and said we can just go to court. I didn't fancy an increase in my insurance for something that wasn't my fault. They paid up in the end before it got to court.
