To think neighbour should pay for damage?

Our next door neighbour's wheelie bin has crashed into our car and damaged the taillight. The bin is left by her garden backdoor in the private car park we all share. The bin was empty and unsecured and the high winds have caused it to roll 6 feet away and cause the damage.

Neighbour says she is not liable to pay as it was an accident however we will now be left £36 out of pocket. AIBU to think she should pay?

No... it was an insane wind and you could just as easily argue that your car shouldn't have been on the way?

It's an accident.

Fair play OP I think that was a really decent thing to do. I didn't think the note was great either, but her reaction was very poor. I'd absolutely offer payment in that situation.

I think you can absolutely claim the high moral ground on this one now 👍

I'm laying in bed with the kids and can hear the wind howling. I've just heard some recycling boxes going down the street. I doubt you'll be alone with this problem by the end of this week.

Why should her bin be in her garden if everyone else keeps theirs by their garage?
Also not sure how you can say you have nothing to do with her if you mow her lawn and things. Glad you apologised for the note though

I didn't think her bin should always be in her garden just on windy days. 99 percent of the time it doesn't matter. I've never seen anyone else's bin move about. I think as they are against a large back wall, there are cars in front and they are often wedged by the recycling box that they are more stable.

I really don't have that much to do with her, it's dp that has helped out (I don't even mow our own lawn let alone anyone else's!). Ironically he was much angrier about it.
