Notice to landlord date?

I can’t make sense of Google!

Say our tenancy ends on the 5th (today) and we find somewhere new to live tomorrow and give notice tomorrow, do we pay 1-2 days extra or a month?

General rule of thumb is 28 days notice

I think you need to give notice on the same date of the month that the contract started so if you LL wanted to be difficult and you give notice tomorrow he could wait until the 5th March till it comes into effect. I could be wrong though, I'm sure someone more knowledgable will be along in a bit

You need to check your lease, normally it states the amount of notice required and whether it is effective from the next rent payment date.

So, if you give notice tomorrow 6th (which is presumably the first day of your rental period if today is the last), then you can leave on 5th March and must pay until that date. However, your tenancy agreement might stipulate a different amount (2 months is not uncommon) which you would have to follow what is in the contract.

If you don't give notice til the 7th, then you would be not be able to leave until the 4th April (because the earliest date you could serve notice after 6/2 would be 5/3, one month from this date will take you to 4/4).

It is important that you get this right, as there is effectively only 2 days each period that you can serve notice.

They have no obligation to. You can leave by the tenancy end date with no penalty, (as long as you are paid up to the end date) so generally they will, to ensure that the property is just not left empty, but they have no need to.

If you do not leave by the end date, the contract rolls over, and you will need to give the notice as above or as is in your contract.

Look very carefully at your lease. Every lease I have ever has said one month to be given whenever. However, our final one had a nasty surprise buried right in the middle. It basically said that we could only give notice the day before rent was due, otherwise they would charge up to the next rent date. It basically means that they could potentially get up to two months from people if they hand in their notice on the wrong day. In our case, we paid an extra 2 weeks (about £410). This was never pointed out to us when we moved in plus as we had just bought, we didn’t dare give in our notice until completion date in case the chain collapsed. Very annoying though 😡

This is the standard minimum as per the Shelter guidelines. One month from the first or last day of the tenancy period.

I am a landlord. I request a tenant to give one months notice that they want to leave. It makes no difference to me on what date. Closer to the time they give me an exact leaving date and I work out the rent owing, which may involve an extra few days. Most landlords are flexible if they are not using a management letting agent.
It is not in my interest to make a tenants life more difficult or expensive.
Have a look at your tenancy agreement ( assuming you have completed your first 6 months) and if possible pho=ne up your landlord

as to your question, if you only gave me one days notice that you were leaving I am afraid you would pay one months rent in lieu of notice

@mrsm45s Not quite sure why I am being made out like the thicko. I have rented at least 5 properties and this is the first time this has happened. Hence our surprise.
