Suspension from work

For anybody that may remember my posts and for any of you lovely people that tried to help me, thank you so much!

I had to resign because of the way the disciplinary was handled.

I DID attend. I thank the HR manager and her colleague that handled the process, they really did put me at ease.

I was so happy I attended. So many facts had been omitted beforehand.

My attendance meant I was listened to. So for anybody facing a disciplinary, please attend! Record every moment, verbally or physically if you must.

The outcome for myself was a written warning.
Unfortunately the treatment I received from my manager prior to and during my suspension meant I had no other option other than to resign.

What makes this really hard is that I am being refused my holiday pay owed.

I was on a 0 hours contract until this Summer. I had accumulated over 60 hours of holiday pay. They are refusing to pay it.

Whilst suspended I only recieved my basic pay of 36 hours despite having to request annual leave on my regular overtime previous to that.

I'm not here to ask for advice. I know I'm fucked. I just want anybody new to the workplace to know how they can be completely fucked over if they don't keep records of every hour they work.

Please please please keep records of your working hours. Signed timesheets, digital login/logout, etc, Honestly, anything will help, records are priceless.

Please just make sure your records are clear and concise. Your manager will not hesitate to sign a record stating your working hours.

In my case, my holiday was calculated based on me working 37.5 hours a week when in fact it was 52 hours a week.

I really don't want anybody else to be in my position .

Please take heed those new to the work place. Especially those working regular overtime.

I know this isn't the best category for the post but I just want to reach out to as many people as possible.

Thanks for sharing your advice.
My dc work on zero hour contracts, and all the staff often swap shifts amongst themselves, or even split shifts.
To be fair, their employers are very good, and this flexibilitiy is seen as a real positive by all the staff but I keep emphasising to my dc how important it is for them to keep a record of when they actually work, as opposed to when they were originally booked in to work.
My youngest has had her pay wrong quite a few months - just through poor paperwork on behalf of her manager, they aren't trying to do her over in this case - but she's been so thankful she's kept the records each day.

OP give ACAS a call, it’s free and they can help you send a scary letter asking for payment. Employer might pay up rather than deal with the hassle.
You should have payslips showing how many hours you worked per week- from that it will prove you were owed holiday pay.

Also you must have signed a working time directive opt-out if you worked over 48hrsper week. And your employer must have this on file, and must provide a copy if you request it under GDPR subject access request.
If you never signed one, they are really in the poop

Threaten industrial tribunal. You wouldn't win but they don't want the aggro. phone acas v helpful usually
